Folks,
My PD is about 15 days away from the current cut off (EB-2). I got an excellent opportunity in another company that I dont want to miss. I am on EAD since 2007 and maintaining H1 too. The new company is doing a premium H1 transfer. My wife is working on EAD sponsored by my current company. Should I hold back my urge of going to the new company? Or is it ok if I file AC21 before the next month (my guess is next month it will become current for me and once approved, I have to stay 6 months in current company losing out this new excellent opportunity). Appreciate your help please.

Thanks

To my understanding. there is no need to wait for 6 months.

In 2010, I missed the cutoff date by 30 days, but waited all the way till May 2011 to become current again. I wouldn't bet on dates moving as of yet. I would suggest to use AC21 and take up the new opportunity.

Now that my dates are current. Does it make any difference if I move to the new job before oct 1st? The new company has got all the docs required for my H-1B transfer and havent heard from their attorney yet on what they want to do.

But, from my perspective does it make sense to join the new company before Oct 1st (effective date of new visa bulletin where my PD will be current), do AC21 transfer? I am totally confused on what to do now. I definitely want to join new company but want to do it safely so that I can get my GC.
