Hi all,

I have applied for I-485 along with my husband's application and am pending approval. I have my EAD and am currently using my EAD to go to school. I have a need to go to India end of May (for my brother's wedding) and I can't miss it. My advanced parole expired on 02/10/09. I have not applied for renewal as yet. I need to apply immediately so that I can travel. Here are my questions related to this.


1: Can an applicant using her EAD, file for Advanced parole and leave the US before it is approved ? Would it be acceptable for the person to return back to the States once the parole is approved, assuming my husband mails the document to my India address ?

2: How long does it take for advanced parole to be approved these days ? I live in MD. I guess I have to file at TSC.

3: Is the application for "Adjustment of Status" considered abandoned if the person leaves the country before the advanced parole application has been approved ?

4: I noticed I can e-file I-131. Is e-filing any faster than paper filing ? If I e-file, would the application still go to TSC ? Bcos I hear TSC is very slow.

5: Where should the supporting documentation be mailed to if the person e-files ? Is it to TSC ?

6: Can I-131 be expedited (PP) ? How long does it take if expedited?

7: What is the premium processing fee for I-131 ?

8: What are my other options to travel and come back, other than using AP ?

9: Can I file under humanitarian category. Not sure if wedding would fall under that category ? Do I have to submit any supporting documents to prove ?

EAD has nothing to do with AP. EAD is for WORK and AP is for TRAVEL abroad, while your AOS is pending. You should not leave US while your AP is pending.

any where from 10days to 4(or 6) months

Yes

Regardless of the way you file AP, the process time is same...for e-file the system automatically chooses the processing center

Under extremely urgent condition

No premium processing for I-131

8: What are my other options to travel and come back, other than using AP ?
Since you are on AOS, AP is the only option for you right now...or if your Husband is on H1 you can go to H4 status, but you need to get the visa stamped at a US consulate/embassy

Do you really think yours is a humanitarian cause?? well, then OF COURSE you have to produce supporting documents to substantiate your claim as 'humanitarian'.
