Hello ,

I am under the followign situation.

Recently I received an RFE for my I485 (dependent) with the following details:

1. RFE Issued on 06-15-2009
2. RFE received by me on 07-03-2009 with a deadline of 07-29-2009
3. I responded to the RFE on 07-27-2009 with USCIS received on 07-28-2009 via FedEx over night.

RFE requested for the following info.

1. Proof of Bonafide marital relationship
2. Completed G325A

The case hasnt been updated in the last two days... FedEx tracking indicates it was received by shipping and handling of USCIS NSC and signed for.

How much time it generally takes to show up on the system ? I have my personal exp earlier it got updated in a day and for many of my friends its either on same day or in a week.

I know i can wait for a week to give some room, but concerned on response deadline being 07/29 ? and implications if USCIS considers it abondoned even if it lying in thier receiving department...

Let me know any thoughts or any one went through same shoes. ...

Keep a proof of delivery with you. As long as the delivery was made and signed by USCIS rep on or before 7/29, you should be ok.

My status was updated in 2 days after the RFE response was delivered at NSC. I would give it another couple of days before getting concerned about it. As per my attorney, only the assigned I/O will open your RFE response so if that I/O is on vacation the online status update will be delayed. In fact my attorney had mentioned that in some of her clients' cases, the status never got updated but they have received EAD and AP renewals after that.

Thanks ebizash, but what options exists if after a week nothing much has changed.

When i spoke with level 2 IO they suggested waiting for atleast a week before the service center is notified. How is it different from Infopass appointment ?

Its been a week now and i have seen only soft LUD's one on 7/31 and one on 8/2 :-( should i take any infopass appointment but my lawyer said there is nothing they can do.. and it some times happens this way best way is to hold on to the receipt...

Any other experiences please ?

It usually reflects that the response to the RFE has been received and the processing has resumed. I had infact responded to an RFE last week to NSC and the current status had been updated to the below quote and also received a CRIS email the same day they received it.

Current Status: Response to request for evidence received, and case processing has resumed.

My only question based on your post is, Did you make any special arrangements with Fedex to have it delivered to a P.O.Box ? Coz they usually don't do that.
I had to send it thru USPS express mail. I do not want to confuse you. But it would help if you could verify or find out how the package would be handled if it did not go to the P.O.Box. and went to the NSC office instead.

If you have already done that and have the "USCIS" signature seal proof, I guess you are okay.

Fortunately i have been sending details to NSC either EAD or my 485 itself. In all the cases I use the NSC courier address and it was indicated on USCIS website to refer to post box so that the internal receivables can route appropriately. Hence i used line 2 on ship label to indicate PO BOX.

Coincidence is it is same person who signed for my 485 aswell... Case status never updated. only soft LUD on 31st and 2nd called a couple of times and spoke with IO but no help. they said it just happens and hang on to receipt and inturn asked me why worry if i have the proof of receipt .. anyways.. this is how USCIS operates...

But i had the same problem last year with my EAD hope this helps... WillIwill i just pmed there is no need to do JUST USPS you can use regular couriers too..
