View Full Version : H1B transfer and stamping - Help

I came to US on L1 and got my H1 approved with employer A. I worked with employer A for some time. Very recently I transferred my H1 to employer B and started working with employer B. I have worked with employer B for just 2 weeks now.

I got an offer from employer C and he is ready to transfer my H1.I want to join employer C.

My questions are:

1. Is it a good idea to apply for transfer so quickly with company C?
2. I want to go to india for Stamping. should I go to india and get my visa stamped as company B employee ? and then after coming back apply for transfer with company C? or
3. Apply for transfer with company C and if approved join company C and immediately go for stamping. Do you see any risk with stamping if I join company C and go for stamping immediately?


Please advice.

It really depends on you. If I were you I would evaluate which option is better. Like how big is company B vs company C (revenue, # of employees esp US citizens)Is there a legitimate employee-employer relationship. Do you have at least 3-4 paystubs to show. Do you have an end client letter if you are working for a consulting company. Has company B or C under USCIS scanner for any reasons.

3. Apply for transfer with company C and if approved join company C and immediately go for stamping. Do you see any risk with stamping if I join company C and go for stamping immediately?
There is always risk in going for H-1B. The 221gs which show up every now & then. But all this is irrespective of which company you work for. As mentioned earlier, I would evaluate all above mentioned points & then make a decision
