Hi,
I recently got married. Both my wife and I are Indian citizens. My wife entered USA under a student visa (F-1) several years back and finished her master’s degree. Then she worked for a US Company under H1B for 3 years before leaving USA. She is right now working in Switzerland for last 3 years. She is planning to come back to USA in near future since I work in USA under H1B visa. I have several questions regarding her possibility to reenter USA:
(1) If she finds a job here in USA, she will file for H1B. Will her new H1B be under the H1B cap? Can her employer file her H1B anytime of the year since she was already working in H1B in USA? Is she going to get a fresh H1B for a possibility of extension for 6 years?
(2) If she does not find a job in USA, she will enter USA under H4. Can she file for H4 at an US embassy in Switzerland since she is working there right now? Is there going to be any issue to get H4 visa since she was in USA in F1 and then H1B. She also recently visited her family members in USA under visitor visa which is still valid in her passport for next 8 months.
