View Full Version : help needed regarding tax refund for spouse after getting ITIN

I have filed my Taxes as H1 B alongwith my wife(who is on H4) in April 2011( shown the status of ITIN as "applied for").I had received the refunds prior to her ITIN. I was informed by the tax filing agency that i will receive the amount of refund under my spouse section once we receive her ITIN. I had applied for her ITIN and received it recently. I tried locating on the website of IRS to find the refund, but i am unable to do so .
Please let me know does the refund chk for her will come on its own or i need to follopw up with IRS and if yes, when should i contact them and how?

1. When you apply for ITIN you have to file it along with your tax returns. Did you do that?
2. I guess yours was a husband and wife joint filing. So whatever the refund you received is your final refund, you won't get anything else for your wife.
3. If she is on H4 obviously she didn't had any income so what separate refund for her are you expecting?

Yes, i have sent the tax returns alongwith the ITIN application.As i mentioned that i filed the taxes in April 2011, and we got hte ITIN no. now.

Yes, i had done the filing manually on paper through agency as my wife's ITIN was not there at that time.. We were told by the agency that once we get the ITIN, we can file the tax returns online for the next time and we will receive the get the refund for her for her after we receive ITIN, so i had asked that query.so do you mean to say that whatever refund i had received from federal and state is the final refund amount.

If you have filed as filing jointly, you wont get any more refund.

Just look at your tax filing form.
if the refund amount claimed is the amount you received then there is NO further refund (assuming all the calculations were done based on married filing jointly). If you received less than that then there will be a refund. Otherwise there is no other magical refund (though we wish there was.)

I referred the amount on the tax returns, it is more than what we have received till date.
I have put the query here to find out where i can reach to follow up for the balanced amount.Though i have tried contacting local office of IRS, but it is giving the message that it is closed(i have called on the correct working hours as given on website) and on the website after putting, ITIN no, date of tax returns (whatever asked on website-that will also be asked when i call them directly on the nos. given, it is not giving me correct details.I will try to contact them again.
