View Full Version : Urgent...Received Date on H1 extension Receipt

Hello,
My original H1 expired on 22nd October, which was a Saturday. My lawyer fedexed out the H1 extension application on 21st October through overnight but the fedex location from which it was mailed out said that they do not provide services that could make this package reach on saturday even though it is sent out through overnight. The earliest it would reach on is Monday, 24th October. The package did reach on Monday, which is 2 days after my H-1 expired. According to my lawyer, because my H1 expired on a weekend, I will still be considered filing the extension while I was in Status.

My Question is:
1) Is that true?
2) Has anybody gone through the same situation and faced any problems or has got approval?

Another Scenario that I am facing is, we received the receipt of the H-1 extension. It seems the file that was sent out on 21st October and reached on 24th October, came back twice from the service center, one for the missing signature and the other time for wrong retaining fees. Each time, the file was sent back to the service center 2 days after it was received. But, now the received date on the receipt is showing 22nd November instead of 24th October, which was when it was originally received.

My question is:

1) Is this a problem?
2) Will I be considered out of status from 22nd October to 22nd November?
3) Does the service center needs to be notified about the wrong receipt date?

I do not want to go through consulate processing or deporting.

Would highly appreciate help from the Legal Expert and also information from the people sailing in the same boat or gone through the same scenario at the earliest possible. I have still waiting for my company's lawyer's response but, I guess he might take time to respond and my mind just can't wait that long.

Sorry to hear that. but its not new with USCIS or with lawyer to screw-up

I had a similar situation. My H1notice had wrong starting date. After numerous calls and letters by lawyer to USCIS and my numerous infopasses didn't help, i contacted the senator. They corrected the dates and sent amended notices within 2weeks of senator's intervention.

I would like to know did you have the weekend scenario like I have. I mean there is 2 days diff. between H1 expiry date and the package received by the USCIS for the 1st time. If yes, did your H1 extn. get approved?

Also, do you know if the USCIS are suppose to put the receipt date as the date when the package was first received or are they correct by putting the dat when the application was last received with all the correct signature and fees?


Also, would highly appreciate get as many expert inputs and experiences as possible.

Its a very tough situation for me. Thank you all in advance.
