View Full Version : How to know if you have been Pre-adjudicated ?

For a long time we have been hearing from various sources that despite the fact that the Date is not current still I-485's are being Pre-adjudicated ?.
Is there a way we can know if our application has passed this litmus test already or is pending ? ................... had a soft LUD in March sometime.

I am not sure a soft LUD necessarily means that your case has been pre-adjudicated. I think you should be able to get an InfoPass appointment and ask the immigration officer directly. I don't know whether calling customer service is an option.
On the other hand, if you get a call for an interview, then they tell you right away about the current status of your case.
Even, I had a soft LUD in April, but I am not comfortable thinking that my case has been pre-adjudicated.
Maybe someone else has other ideas...

Some ways of knowing
-- You had RFE
-- LUD which is not linked to address-change or fingerprinting or any other know reason.
-- You have been called for interview
They will look at your application again even if you are Pre-adjudicated when they have visa numbers and your application is current.

You can get a letter about it but only in rare cases. Yesterday I spoke to a member who got it. His was a special denial circumstance case where USCIS was contacted.
By and large you cannot know. I had posted an update on pre-adjudication few days ago on the donor forum.

Infopass may or may not help. Depends on the officer. As such, Infopass officers are supposed to give you the EXACT status. But it may not show up on their computer if it is preadjudicated or not.
Once preadjudicated - they may never bother to touch your file until your dates become current. But that does not mean it is equal to getting a green card because as long as the file is with USCIS, they can open it or deny it or whatever based on a changed situation.

Just one correction, soft LUD is not a reliable indicator. When I filed for EAD/AP renewal, the officer looked at my 485 it also had a soft LUD.
I have had no RFE whereas my friends have been getting RFEs. No other soft LUD after 1st fingerprint. So this can not be an indicator.
I went for InfoPass and the IO asked me which country I was from and then looked up the Visa bulletin and said you are not current. Come back after your visa date is current.

In the march performance report USCIS claims that they will preadjudicate all the applications by FY 2009, that would be September 2009. Not sure that will happen or not but there is one clear trend, NSC is way ahead in the preadjudication process compared to TSC, I am saying this based on the RFE issued by NSC to TSC which is about 8:1 (not scientific :)
