View Full Version : Traveling outside the country - I-485 applied

Hi - My husband and I just got current. We will be applying by Feb 1st.
We have an upcoming India trip around mid-Feb. Here are the details of our visa statuses.
My husband has a valid H1B visa and stamping that expires next year.
My H1B is expiring in April 2012 but my company has filed for extension (hopefully I get my papers by mid-Feb). I need to get my visa stamped in India.
(My I-485 will be filed with my husband's green card petition.)
Will there be any issue travelling in such a situation?

There seems to be no issue. But I think you may be coming back before Apr 2012 else, you may need to get your visa stamped. But there also pending 485 doesn't pose any problem.

I have heard that if you leave the country while ur I-485 is filed and enter back in the country on ur visa and not on AP / EAD then its considered equivalent to abandoning ur green card. I am not sure how true this is.
Also, there are lots of cases of putting H1Bs in pending state when going for stamping so my opinion would be to postpone the trip if you can. If not then check with the lawyer and all the best for your stamping.

After filing 485, if you have valid H1B visa, you can enter on the same. It does not affect your pending 485.
