EB2 eligibility over team members

Hello ..

I tried to find the answer but i do not find exact match for my situation ..
My company was applying for me GC as EB2 while i was first talking to Attorney .. But due to an another member in the team who dont qualify for the same .. and need to apply EB3 ..
My attorney and HR can no apply for EB2 and EB3 from same team :mad: .. and my manager can not go against it ..
My profile normally required/publish a Bachelor + 5 yrs but its not mandatory if exp. is good ..

So i am in situation where i do not have option to apply with EB2 ..

What your advice in this situation ?
Should i apply for EB3 or not ?

I am on L1 so less chances of job change ..

If both you and your coworker are in similar role, it is difficult to justify.

I would suggest go ahead with EB3 for now. You will at least have the Priority Date reserved. Then try for a different job where you can have EB2. That way you can still avail of your current PD

Completely agree. Is there a way for you to have a internal transfer to another group inside the bank. EB3 Sucks .. only reason you want to get into it is to reserve the priority date and get H1 extension beyond 6 years.
