View Full Version : (Urgent) reentry question

Hi, I need some urgent advice. I got my green card about 2 yrs ago in March 2010 (EB2). Since then I spent about 1 year (till Jan 2011) working in the US for the current employer with minor travel. Since Feb 2011 I have had to travel abroad for extended periods of time to Europe to interface with customers for my company (I continued to get paid in the US and my travel is just normal business travel except for the length). I spent between 2 and 3 months around 4 times in the last year. I returned to the US for 2-3 weeks in between each extended trip. Yesterday when I landed in the US, the immigration officer warned me that I was spending too much time abroad and could lose my green card if I continue this without a reentry permit.
Can somebody advice what the rules are for applying for a reentry permit? In general I am absolutely not abandoning my US residence in spirit, I continue to pay my rent, utilities and so on and come back every 3 months to my US office.
The problem I have is that I have to do one more stint for about 2.5 months from Feb 2011 to April 2011 before I wrap up the project. This is urgent as the project has entered a critical phase and I need to make travel decisions quickly.

You meant Feb 2012 thru Ar 2012 :)

Next time, please take all the papers such as your rent stub, utility bill, car payment (if any) and anything else that proves that you are infact a U.S resident just travelling on business. Infact, you don't need a re-entry permit if you are not absent continously for more than a year.

Indeed I meant 2012, thanks. I will check with my lawyer, I was a little disturbed by the way I got reprimanded at the immigration counter. I wasn't asked for any proof of rent etc which I can easily provide at any time but rather told that I need to be physically present in the US to "maintain my green card". It would be a little bit like house arrest if I cannot go on extended business trips as my job requires (especially in this age of globalization where most companies have foreign offices and customers).
