View Full Version : 485 - Adding new born name without SSN/Passport

Hi,

I am expecting new baby in my family in another 1 or 2 weeks time and I have to file for I-485 as my priority date is current. New baby will be US citizen as per US birth rule.

Should I wait and add new baby's name during 485 filling or it really does not matter as baby will be US citizen? I won't be having babies SSN or passport for another 1 or 2 months as it will take time to apply. Please suggest your thoughts.

Can I add my babies name later or not needed ?

Your baby doesn't need a green card - or be associated in any way with it (being a USC).

I had the similar situation and our baby born 1 week before filing and I asked my attorney that do I need to wait till he gets his passport or not.My attrney replied as he/she does not need any visa number,the name alone is enough.And I provided the name and filed 485.

What ?? your attorney advised to add your US born baby to I-485 ??? He/she is already US Citizen and no need to add him/her anywhere.

You are kidding right. ANYONE born in the USA are US citizens, don't you know that? Who is your attorney? Please report your attorney here so that others who are using that attorney will be careful. OMG!!!

YES you have to list your US born child name on your I-485 application and check NO for the option "Applying with you?"

Yes...you still have to add your kid to the application and select No for if applying with you..

We applied I-485 2 months before my son’s birth and I asked my attorney after the birth about adding him to the process, she said no need to do anything. So may be if you apply I-485 after the birth, need to include him/her. But I'm not convinced that why you need to do that ? You're filing AOS to become Permanent resident and why US Citizen needs to be include in that application. Doesn't make any sense to me. Well a lot of things are not making sense with USCIS so I’m not going to argue with this.

If you look at Part-3 Sec-B of your I-485 application, it instructs you to list all your immediate family members, irrespective of their immigration/citizenship status.

We applied I-485 2 months before my son’s birth and I asked my attorney after the birth about adding him to the process, she said no need to do anything. So may be if you apply I-485 after the birth, need to include him/her. But I'm not convinced that why you need to do that ? Yes... thats correct and we need to add all family member names irrespective of status on I-485 as i know one of my friend got problems during IO Interview time and Immigration officer rejected to consider my friend's daughter even she born in US after I-485 filed and after struggle & several follow-ups finally got GC after 2years of current date.
