My spouse is Primary who filed 485, EAD/AP in January this year. I am beneficiary derivative and my application were filed with my spouse. I am currently on H1B. EAD/AP, 485 all pending for both me and my spouse. I-94 is valid till 2013 Now I want to resign and take break for sometime. Do I need to file for H4 before I resign or I can resign and be considered in status by virtue of AOS pending (i dont have EAD approved yet but will be soon going for biometrics).
If I must file for H4, what documents I need from current employer to change the status back to H4 and what is the process for doing that.
