View Full Version : Writ of Mundamus - fee?

Does anyone has an idea how much the legal fee runs for filing a Writ of Mundamus? The pre-trial fee (the time when you give CIS x number of days to respond) and then actual trial fee (if you actually proceeded with filing WOM). If anyone has had experiences, or knows about the reasonable legal fee, please share. Thank you.

Well couple of the posts in immigrationportal.com suggests that, it would be $3000. For the first part including filing with court. But I think it depends on state and lawyer. I'm still in look of an Atty who could do this in my state.

It is defined as:

"A judicial order directing a government official to perform a duty of his or her office."

Basically it is a lawsuit that you to make the CIS adjudicate your case if they've taken simply too long.

I filled the lawsuit and my I485 pending with FBI Name Chack pending. My Lawyer asked for $2500.00, another one asked for $1500.00 and then I searched for the best lawyer in Ohio and he asked $3000.00. I told him Idon't have that money and I have to borrow it and that one lawyer told $1500.00. He agreed on 1500 and I filed couple months ago.

I filled the lawsuit and my I485 pending with FBI Name Chack pending. My Lawyer asked for $2500.00, another one asked for $1500.00 and then I searched for the best lawyer in Ohio and he asked $3000.00. I told him Idon't have that money and I have to borrow it and that one lawyer told $1500.00. He agreed on 1500 and I filed couple months ago.

My greencard application has stuck in name checks for 3 years. I recently filed a Writ of Mandamus. Before going to court, U.S. Attorneys filed to dismiss my case, citing that the adjustment of status is discretionary and the FBI can take as long as they want to do background checks.

I am hesitating whether to go ahead with a court hearing. In addition, I am not happy with my current lawyer.

Can someone recommend a good lawyer to me? Many thanks!

Post copies of the papers filed with the court here or on yahoo groups. They are public record anyway.

This way others can clone and amend documents and either file Pro Se (representing self) or use to keep costs down with attorneys.

Also post copies of all documents filed by US attorney in response.

When a winning argument is found others can use the same.

Also remember a US attorney should have better things to do than go to court on every FBI name check. So the more that go to court the more likely they are to just pick up phone to FBI and say "could you do me a favor", if that actually goes on.
