I understand there have been multiple threads on this scenario, but I couldn't find all the answers related to my scenario.
My wife's I-140 was approved in April 2011 and in October 2011, the company she works for was acquired by another firm. I do understand that an I-140 amendment needs to be filed with USCIS as the company's federal tax id changed.
1) As her H1 expires in May 2012 and we need to apply for an extension, would she be given a 3-year extension or just 1-year based on only the PERM approval?
2) Can I-140 amendment be filed under PP?
Appreciate any information on this.

...and ask if her previous I-140 approval would apply towards 3-yr extension. You don't need waste money on PP as you have till May to apply for extension. Apply I-140 amendment ASAP and hopefully it'll get approved before you send in her H1B extension. If previous approval can't be used towards 3-yr extension and the amended I-140 is not approved in time, you can always go for PP and then apply for H1 extension...

As I understand, as 140 amendment is not required. What you need is a letter of succession from the new parent company which states that they now acquire all asset and liability of the old company. Talk to attorney for format
