I agree IV is busy with HR3012. In parallel, can we also push for USCIS to grant indefinite EAD/AP (validity until I-485 is approved/denied), instead of just 1 or 2 year validity. I believe this can be an administrative fix and will save a lot of time and money for USCIS, particularly with the new I485 filing fees there is no fee charged for EAD/AP renewal.

I do not think its worth diluting the efforts spent on HR3012. We need to focus, else we can run the risk of not achieving both.

Since EAD / AP gives them money while new applciants can't file I 485 why would they stop it ?

Its full time job with 8 hours in the evening shift. And I would like to apply EB2 with the second job. Appreciate if anyone provide pros and cons. Thanks.

Looks like my profile was wrong. It is showing I am EB2 with Sep 2009 priority date. It is wrong. I am on EB3 with 2003 priority date. Looks like some App or database corrupted. I will update the profile anyway.

This forum is for HR3012 and for supporting IV in this effort. I am sure there are other avenues to ask your question about EAD/EB2. Please keep the discussion focused on our support for HR3012.

Please refer to the earlier post from Pappu. There is a reason why IV has an embargo on new donor forum memberships. All we can do is be patient and support IV in all ways possible. As someone had said earlier in this thread " updates and passing of the bill" are probably mutually exclusive. And yes, I am like so many others "a donor and who doesn't have access to donar forum."

As someone has pointed out, it's really a test of patience. But I have utmost confidence in IV, and this isn't dismissed yet. At times like these, retaining talent is everything for the Americans and IV is helping them show that.

If you have US born children they can sponsor you under Family Based Category when they reach 21.
So theoretical waitime for EB3 is like 20-25 years.

Guys, discussions like these are not helping our's and IVs efforts. So many poster have been cribing about not receiving any updates. When we believe that IV is making efforts, why don't we trust their decision to not provide updates at this time. There IS a reason and STRATEGY behind it. As has been repeatedly pointed out on this forum, law making is a long drawn process, and we HAVE to understand that. So, unless we have anything constructive to write about efforts for passing HR 3012, lets not occupy space on this forum. By not doing action items we may hurt our own cause. So lets use this time to do our action items.

Congress is not enough, HR 3012 needs super majority of 60 to pass.
You cant rule out some filibuster attempt. After all last time it failed in Senate.

I don't know how long the porting will be allowed by USCIS. But it is the only option for long waiting EB3 people. My friend has been waiting with Dec 2002 PD. I think I will beat his date with a yet to be applied EB2 porting new application. It is sad, but true.
Any base or proof to support your statement ? If not keep your assumptions/guess with you. There is no need of personal opinion & it does not help any one. On the contrary it defeats the purpose of this forum & hurts the efforts.

I understand the sentiment but it is what it is. Don't mean to rain on the parade but it looks like its very tough now. IV core made a sincere effort and they brought the bill this far, which has never happened before. But the truth is that the bill doesn't seem to be going anywhere. Whatever is the outcome, I very much appreciate and applaud their efforts.
Statement/Clarification from IV Core Team is requested to curb pessimistic assumptions, so called Truth spreading around.

When did your attorney told you that? In fall of 2011 the prospects were very bright....I don't have any insight now so wondering when did your attorney told you to wait for 3012.

I am not spreading pessimism. I have donated to IVs advocacy efforts like others here and I appreciate their initiatives to make this work. But I just wanted my fellow EB3-ers to actively look for porting to EB2, if they can.
There are lot of jobs out there. My company has 4 open positions for last 4 months and they could not find right candidates to fill those positions. I have got two job offers, which I used for EB2 negotiation in my current company. So I suggest to fellow EB3ers to get active, if GC is their top priority.

I saw the news in Irish Central that Scott Brown announced his inability to get Irish E3 bill passed. That suggested a good groundwork to pass HR 3012 standalone.Now based on the previous data released by USCIS there seemed to be enough visas available but suddenly there is none available even after the new fiscal year.Are they setting the ground for HR 3012 while discussions are made in senate?

I have been waiting for last 10 years....it may take another 5 years at least to be current.
Which is 3 EAD extensions away... No big deal. Mean time I keep contributing to IV , will participate in advocacy efforts.

It is quite comforting some times to hear from fellow IVians , that I am not fighting this alone.
I saw many people who came to this country before me got their GCs and became citizens, I came to this country in year 2000, applied GC in 2003...may get greened in 2017 at the earliest. Life goes on.

Full Senate Could Take Up Trafficking Victims Protection Reauthorization Bill Containing Immigration Provisions: The full Senate could at any time take up S. 1301, the "Trafficking Victims Protection Reauthorization Act of 2011". The measure contains a number of provisions relating to alien trafficking victims.
The Senate Committee on the Judiciary approved its version of S. 1301 on October 13, 2011. It was formally reported to the full Senate on November 17, 2011.
At the time of this writing, no date for full Senate consideration of the measure had yet been set.
Full Senate Could Take Up Bill Revising Annual Per-Country Limits for Employment- and Family-Based Immigrant Visas: The full Senate could at any time take up H.R. 3012, the "Fairness for High-Skilled Immigrants Act of 2011. As passed by the House of Representatives, the measure would eliminate the annual per-country limitations for employment-based immigrants, and it would increase the annual per-country limitations for family-based immigant visas from 7.5 percent of the total number of available visas to 15 percent of the total number of available visas. The House of Representatives passed H.R. 3012 on November 18, 2011, by a vote of 389-15.
At the time of this writing, no date for either full Senate or Senate Judiciary Committee consideration of the measure had yet been set.

Full Senate Could Take Up Trafficking Victims Protection Reauthorization Bill Containing Immigration Provisions: The full Senate could at any time take up S. 1301, the "Trafficking Victims Protection Reauthorization Act of 2011". The measure contains a number of provisions relating to alien trafficking victims.
The Senate Committee on the Judiciary approved its version of S. 1301 on October 13, 2011. It was formally reported to the full Senate on November 17, 2011.
At the time of this writing, no date for full Senate consideration of the measure had yet been set.
Full Senate Could Take Up Bill Revising Annual Per-Country Limits for Employment- and Family-Based Immigrant Visas: The full Senate could at any time take up H.R. 3012, the "Fairness for High-Skilled Immigrants Act of 2011. As passed by the House of Representatives, the measure would eliminate the annual per-country limitations for employment-based immigrants, and it would increase the annual per-country limitations for family-based immigant visas from 7.5 percent of the total number of available visas to 15 percent of the total number of available visas. The House of Representatives passed H.R. 3012 on November 18, 2011, by a vote of 389-15.
At the time of this writing, no date for either full Senate or Senate Judiciary Committee consideration of the measure had yet been set.

Just watched the "need to know" episode on Kera.org ( sunday 10am cst )
talking about legal immigration ( pro ) .
"The debate over legal immigration is examined. Included: whether foreign-born technology workers are taking jobs that could go to Americans; why immigrants are more likely to start businesses than non-immigrants. Also: a Jon Meacham essay."
HR 3012 was shown with other stack of bills, and was commented " not comming any time soon".

You are looking at the situation with jaundiced eye. So basically system should not do the enforcement , checking, verification , setting rules and policies to avoid loopholes everything has to be done by us. Can I get the listing of how the GCS were awarded per category per country from 1999 till 2012? How can they approve PERM petitions when the people before PERM are still pending (they were onveniently put in a backlog queue, where was your self consciousness then?), I don't say we all part of problem but its not just Indian, its everycone, everyone who could exploit the system exploited it. So according to you, because you have been waiting, so all others ahead of you must be fraud and all others must have somehow scammed the system? Per your post, only you are the deserving one because you are a doctor and all other "indians" must wait because if someone is "indian" then she/he must have been abused by their employer? Is that what you are trying to say?
A while back, someone on these forums said that everyone here sees the system (and the world) based on their own personal situation and everyone wants to change the system to best suit their own situation. And in the process, every one leaves no chance to claim that they are victim of the backlog because everyone else is fraud/abused.
This observation is so real, its pretty much evident and applicable in every post on all immigration forums. Your post is no different.

Hi Guys,
This kind of discussion is not helping anything at all. I know this is a frustrating period right now as the bill is not getting tabled. We are not achieving anything by pointing fingers at each other. The fact is HR3012 will help a lot of people, of course like anything else there will be some bad apples. But this should not distract us from our efforts which will help the larger community in general.
Please do not stop doing IV action items and contributing. Remember what the british taugh us "divided we fall."

There is nothing any public campaign and action item can achieve at this time. It is all now more focused advocacy work. This is why there is no public updates. Getting a bill passed takes a lot of time and effort. Wish it was easy but even to bring into house, we spent one whole year of focused hard work. Publicly on forums people only saw it a couple of weeks of work and action items. The only action item at this time is to support this organization continue this hard work to bring our end goal closer.. Please subscribe to monthly contribution if you have not. We are confident that with everyone's continued support we may we able to post public update for bringing relief soon enough. We all just need patience and faith. Nothing is impossible if there is a will.

I would suggest creating a paypal account if you do frequent online shopping or payments. You just need to give your credit card info to one website instead of to several websites for online shopping. Most of the websites have option to pay through paypal. Since paypal is primarily into this payment type of business my assumption is they would provide the maximum security in keeping your credit card information. Also when you pay through paypal they sent you a authentication code to your cell phone just to make sure you are the authorized holder of the credit card. Just some info to consider.

The bill can move if Dems win majority in House and Senate and Obama is reelected. Otherwise, both GOP and Dems will keep playing politics on immigration without any real change.
The bill can even move with a Republican win and a Republican majority. Dems are not necessarily pro high skilled immigration though Obama is.
End of the day both parties play for their vote bases and currently the base on both sides is resentful against high skilled immigration (or any immigration). Check any comments section on any article about high skilled immigration.
This is why nobody is sticking out their necks for this bill in the Senate, even though if brought to a vote it will probably pass.

HR3012 will encourage innovation by liberating the scientists, doctors and programmers to get job mobility and go on to research new products, start new businesses and services , thus improving national economy.

Probably there is chance upto Aug or September because of election. Final chance is lame duck session on end of the year. Lame duck session is the one when many bills were passed swiftly in past.

When the Irish visa bill was in full swing didn't our beloved senator from Iowa say that he will remove the hold on H.R.3012 if Irish bill is modified in certain way? Since there is no Irish bill shouldn't the senator remove the hold now? Of course I don't expect anyone on this forum to know the answer but I am just wondering..
HR3012 is Part of 'Encourage Entrepreneurship and Growth' , the gentlemen Senator from Iowa should remove the hold , because ,
HR3012 will encourage innovation by liberating the scientists, doctors and programmers to get job mobility and go on to research new products, start new businesses and services , thus improving national economy.

Irish Bill was just an excuse. Sen Grassley is in war with H1B visas....Period.
As such he is co sponsor to another immigration bill S.3245 to permanently reauthorize the EB-5 Regional Center Program, the E-Verify Program, the Special Immigrant Nonminister Religious Worker Program, and the Conrad State 30 J-1 Visa Waiver Program for International Medical Graduates.
He has no problem with immigration on the whole, just that he has issues with H1B , EB.

Person writing this doesnt understand the world of enterprise. Enterprise will never lose any talent that drives its business. They layoff sales, marketing and commodity resources. All the scarcity is in filling that talent, that is most important to business e.g. R&D. Just becoz they announced say for e.g. 2k layoffs doesnt mean they wont hire next day for critical sr. software engineer... Plans change every year based on market direction, i am not supporting their action but thats how enterprise runs. But there is always one data that will bite antis data if you stop immigration i know many companies which moved complete operations to Asian countries. Now is that good to US ? Never. There are many senators and congressman who understands this. Anyone saying otherwise will see the difference if not now.

IV core team and several of its volunteer members have been awake and burning midnight oil more than regular days in the last few months. There is nothing any public campaign and action item can achieve at this time. It is all now more focused advocacy work. This is why there is no public updates. Getting a bill passed takes a lot of time and effort. Wish it was easy but even to bring into house, we spent one whole year of focused hard work. Publicly on forums people only saw it a couple of weeks of work and action items. The only action item at this time is to support this organization continue this hard work to bring our end goal closer.. Please subscribe to monthly contribution if you have not. We are confident that with everyone's continued support we may we able to post public update for bringing relief soon enough. We all just need patience and faith. Nothing is impossible if there is a will.
Less than two weeks back we recieved an update from IV. Moreover, IV has said this repeatedly and it should be obvious to all IV members that giving out regular updates on public forum is detrimental for the cause at hand. I am confident that if there is an update that needs to be shared IV will share it regardless. I believe we can use this time more productively; anyway if IV says the effort has failed what else do you have? Please use this time to spread the work and advocate active support.

It is not dead but stalled. It will be dead if it is failed in Senate vote or not taken until end of the year. Even if it is not passed in this year next year chance is bright as new congress comes. But I think there will be lot of discussion and negotiations in the background for this bill and also Irish E2 Visa bill in the coming months. Those times IV volunteers can work and try to push as much as possible.

Until HR3012 came in to the picture, I had zero knowledge of American legislature process. Now I know atleast 5% of the process, and feel like is not an easy task to take the issue and make the lawmakers to hear your views let alone bringing the bill to the endless process of commitee/house/senate approvals.
This process requires dedicated representatives from immigration community. If you ask yoyurself a question about who is doing this, these are unsung heroes of IV Core. I felt like all other members including myself is not supporting the efforts of these guys enough.
We don't know all the background efforts of IV core, all we see is the end results (ex: House approval of the bill) , honestly minimum every one else can do is support the IV financially ( one of the easiest task) to keep the engine running.
Most of the IV core is already GC holders and they are taking their personal time to fight for fellow immigrants . I have 100% faith that one day HR3012 will become law and we all will enjoy the fruits of the fairness in process. Mean time all I can do is support the IV and help the soldiers (IV core) to fight for us.

He is been telling that from december , he is proposing unsustainable changes to the H1B program in return, with his amendments , H1-B program as a whole would be dead and no one in their right mind would agree for it, and he knows it.

Senator Chuck Grassley of Iowa sent a letter to the Controller General of the GAO of the U.S. Government requesting to investigate the current 29-month F-1 student OPT program. Two of the grounds for the request for investigation appear to focus on the instance of a Pakistani national who attempted a terroristic bomb in Town , New York who was one time in the OPT status, and the 29-month OPT program practically expands the number of skilled foreign workers available undermining the annual cap of H-1B visa program which he is troubled with. Please read the full text of this letter.
It is not clear as to what has motivated the Senator to initiate the investigation request, but it may have something to do with the late Obama Administration's launch of administrative fix of broken employment-based immigration by explanding availability of skilled foreign workers beyond the H-1B annual cap through expansion of so-called STEM list. STEM degree OPTs can extend their OPT beyond 12 months and upto 29 months altogether. This probably is taken by the Senator as bypassing the annual cap of H-1B professional foreign workers, which he is seriously troubled with.

In last 4 days , I read two news from different publications that Grassley has removed or ready to remove hold.
This was never case in last 5 months since he put hold.
I feel something positive is brewing . Hopefully we may hear good news soon.

Actually they can.
Any immigration legislative efforts will depend upon taking this into account for success. So, Senator Grassley will need to a "fix" in some part of immigration law (such as removal of diversity visa) for legal immigration reforms to push through.

Right from 2008 there is a lot of support for IV's mission, i.e,
- End inequality based on country of Birth for Employment based green cards.
- Recapture Visas lost due to administrative delays
- STEM masters grads remain here and not go back and compete
- I485 filing without visa availability (thought to be admin/uscis fix , may be not ?? )
- not count dependents in EB quota , i.e, derivatives count off
So when there are so many co-sponsors for this just causes right from 2008 , I think Senator Grassley's staff and others may have realized they cannot put hold on every TRUTH , every bill and every year, may be the news from politico.com is true and HR3012 will pass and IV will get to work the next ones on the list

It is quite comforting some times to hear from fellow IVians , that I am not fighting this alone.
I saw many people who came to this country before me got their GCs and became citizens, I came to this country in year 2000, applied GC in 2003...may get greened in 2017 at the earliest. Life goes on.

The referred law firm website/blog does report some good info, but most of them, if not all are information that originates from AILA communications / email /update or from web searches on the topics that are of greater interest for the audience he is interested to gain popularity. Might helps him get more clients. The below quoted article appears to be caused confusion, but only thing at least derived is interested parties for and against are focusing on this and the bill could end up for a yea/na vote at some time. In spite of an hold, the bill could still hit the floor.

Proposal is to supply cannot-be-permited-work force to US Business. That means that work force have to stay there for months rotting in the same ship. So, only singles, no families/kids. People come to America in a hope to either settle down or work for long term, if thats not in the road map, it will not click.

IV would have confirmed it by now if Grassley had lifted the hold. IV is likely focusing its resources on getting 60 votes so that Grassley's hold is rendered ineffective.

Probably you will disappoint by my answer.
I am niether someone knows more than ordinary member, not on donor forum.
But just my feelings says. In last 2-3 weeks first time we saw several momentum or news ( including one errornous from politicio ).
The other news,( 3 weeks back) quoted Grassley that he was able to include language tightening on H1-B. ( Which is his ultimate aim . As he already publicly made clear that he is not against removing country cap)
This was never been case in past 5 moths.
Nothing much to share about but sounds something is cooking behind the scenes.
What all I can say let us be positive and do not give up hope.

The HR 3012 was introduced in House in last September. Now it almost nearing an year and how long do we need to wait. From the news I could feel that something is happening.

You should be asking this question to senator Grassley - Wether he wants to have any meaningful reform or none at all.
Many of his proposals are naer impossible to implement and will turn the whole legal immigration system into a red-taped mess with audit delays stretching multiple years.
This will only hurt existing american workers by only speeding up the jobs themselves moving offshore to be done by really low cost wokers that americans cant compete against.
What he is advocating is similar to Graeco-German style austerity while what he should really be after is american style growth and liberalisation oriented policies.
No H1-B worker is going to work at a lesser wage than an american worker if he can switch jobs easily and has a reasonable shot at getting a green card. This will lead to a new normal in woker equality.
Hope the good senator sees it that way.
