View Full Version : RFE on Green Card ??

At the time of filling I485 in Nov, my husband was on H1B visa and I was on Change of Status from F1 to H4. In Dec , I got approval letter for H4. As we have submitted COS and I485 in different USCIS centers, I have few questions :

1) Do i have to call USCIS regarding my approved H4 status?
2) Do i have to mail them copy of my H4 approved letter ?
3) If not done so, will i get RFE on Green Card ?

Please someone kindly answer these questions.

Adjudicators have all the information about you and they would be aware of your transition to H4. Since at the time of filing your AOS you were in F1 status and submitted documents pertaining to that, a subsequent change-of-status should not affect your application. In case there is an RFE you can respond with all your docs about H4. Pre-emptively informing them might not be easy because per I know you'd or your lawyer would need to file an amendment to your application, just calling them would not help. Although, I don't think chances of RFE are high.

There is no need to inform USCIS. During I485 process, my spouse was on H4 with COS to H1 pending. We mentioned H4 as per lawyer's instructions. We never informed USCIS when H1 approval was obtained. There was no issue or RFE and we both got our GC without any problem.
