View Full Version : New H1B visa after I94 extension approval...

Hi,

My H1B visa & I-94 expired on Nov-2011 and received my approved I-797 A/I-129 along with the extended I-94. In the approved petition, the valid date was mentioned as Nov-2012(only one year). Iam planning to take a short vacation to India and come back to US in 2-3 weeks. Here are my questions.

1) For new H1B visa, do i need to show by existing/extended I-129 petition or has to apply for a new petition?
2) If i use a existing/extended I-129 petition, in that case, can i get the visa stamped for more than one year or is it as per the valid date in the petition?
3) Is there any time constraint like i have to have atleast 6 months of valid time in my petition for new visa?

FYI, my original visa was stamped for only one year and i was in us for the past 8 months.
