Can I140 Amendment- Successor in Interest be filed PP

My company was an independent business unit of Fortune 500 company. Due to reorg, that division was Acquired and became independent pvt company.

I had approved I140 with fortune 500 company. Can my new company file for I140 amendment - Successor in Interest in Premium Processing?

Anybody who have gone through similar process, please do share your experience.

I have 140 successor in Interest application filed in Sept 2011.
while filing my attorney submitted fees for PP. USCIS has declined to accept it as premium processing as the original labor certification is contained in the original I-140 file.

Can we still apply for PP? since application is pending for more than 5 months?
