Hi,
I had applied for I485 as a derivative applicant in EB3 (2007) on my spouse's I140. Now my priority date is current in EB2 as a primary applicant on my I140.
So what could be the best option for me?. To file a new i485 or interfile to my old I-485?. My lawyer says it is safe to file a new I485 in EB2 as primary applicant. Also the lawyer says EB2 would have also been current at the time of my EB3 I485 filing date in order to interfile. Is this true?
