View Full Version : URGENT Need Advice!!!

We are based in India and we got a situation and we will deeply appreciate for your advice. This is concerning family based Immigration. My father who is a 'Green card' holder (based on petition filed by his US citizen sister) is physically and mentally disabled due to severe stroke while in India and he needs to return to US before April 1st week!!! in order to retain his Green Card (1 yr rule). He needs assistance from his family members to take him to US and also further his treatment over there. We are trying since November last year to get appointment for our Immigrant visa interview at US Consulate Mumbai as 'Following-To-Join' members with no luck. Earlier US Consulate in Chennai used to process Immigrant visas but now since January this process is moved to US Consulate in Mumbai. The problem is the Mumbai based Consulate is not giving us appointment claiming our electronic file is still in Chennai based Consulate and they asked us to contact Consulate in Chennai and request to transfer our efile for visa processing and granting appointments. The Consulate in Chennai is NOT responding to our mail. I have sent a registered mail with medical certificate of our father to both these consulates explaining the urgency and our situation but to no avail. My younger brother who is also a 'Green card' holder came from US in order to settle this but they denied his entry into US Consulate in Chennai. Also one of the 'Following-to-join' member (my sister) will age out in mid-April. Moreover all our properties in India has been liquidated in order to move to US permanently. This is a really difficult situation for us. What should we do under such circumstances? PLEASE HELP!!!

Why not get a visitor visa and take your father to US? Why are you waiting for GC in such a difficult situation? Your brother should be able to provide you with an invitation.

Like fide_champ said, thats the best option to get a visitor visa- Tourist (B2). Try to apply
Visitor visa, your brother should be able to sponsor you by sending required documents.
If your visa not approved or you think its potential denial then your brother can sponsor
Visitor visa to your family members who is about 50 years or above.
Visitor visa will not be an issue for you if the Immigration officer thinks you are younger
There may be a potential chance of denial. In that case you can try someone in your family or in-laws who is older than 50 years in this case it will work.

Thanks for responding. We are not waiting for our Green Card. Visitor visa will take longer than our Immigrant visa(Green card). Please read my message earlier again. All we need is an appointment for 'Following-To-Join' members which could be given in 15 days.
