Nothing new in this data............. All same from last 3 to 4 months. Another big jump for EB2 and nothing for EB3.

Hi,

I am not really sure I understand this data. Are they saying there are only 50 applications so far for EB2I?

Can someone please explain?

Based on similar demand data EB2 jumped 5 months last time, so it may happen again this time around. Wonder why EB3 timelines never change :-(

EB3 India get only 2800 visa per year. There are a lot of ppl in the queue between 2002-2005 as seen in demand data. Hence it never jumps.

EB2 India gets more than allocated 2800 visa per year based on various rules like spillover from EB1 and EB5. Hence they will always jump.

HR 3012 is the only thing that will help EB3-I.

Based on this data...shouldn't EB2 be current soon ? This should help EB3 as well as the unused visa numbers will flow to EB3..right?

I am not sure why EB2 demand data is low. One reason could be there are lots of applications and they are getting their GC immediately. Demand data is only listing cases that have not been processed completely. So it is a moving target.

EB2-I is unlikely to get current. It would move by several months based on this information.

Even in EB2-I/C becomes current, as per my understanding of the of the current spillover rules EB3-ROW will be the first to benefit.

EB3-I will get spillover only when EB3-ROW is current.

Hence HR-3012 is the only legislative solution which would EB3-I.

Summary

Spillover before 2009: (incorrect interpretation according to USCIS)
Unused EB1 visas was shared between EB2 and EB3
Unused EB1 => EB2 ROW => EB2 retrogressed
Unused EB1 => EB3 ROW => EB3 retrogressed

Spillover after 2009 - changed to the correct interpretation according to USCIS:
Unused EB1 => EB2 ROW => EB2 Retrogressed => EB3 ROW => EB3 Retrogressed.
