View Full Version : L2 Visa stamping got 2nd time 221g yellow with same reason

Hi,

I am in US on L1 visa since Dec'07. My first visa stamping was valid thru Oct 2010 and same for my wife. After that I was on I797 approval.

Recently my wife travelled to India in Jan 2012. Feb'12 she attended visa interview for stamping they gave her 221g Yellow form with reason other “proof of husband is in status(Visa)”
She was carring below documents:

> I 94 (Visa Status of Husband) Clearly states I got admitted into US LEGALLY ON May 17th 2009
> I 797 A (Visa approval of Husband) Valid until 10/31/2012
> W2 (W2 year 2009 / 2010 / 2011)
> Latest Paystub ( Month of Feb and Mar)
> Interview/Appointment letter from VSA
> Marriage Certificate
> Passports New and Old of Spouse
> Employment Verification letter

Second time Mar'12 she submited all above paper and they gave her same 221g with reason asking “Copy of husband’s visa & legal status”.

Has anyone been faced similar situation? What are they asking for husbands visa and legal status other than I 797 and I 94?

I have wrote this to VFS Mumbai as well but no response yet. Please help as my son and my wife stuck and its my sons B'day soon.

You need to give them copy of your visa stamped on your passport even if it is not valid or unless you got restamped after your new I797 approval, give the new unexpired visa copy. Alongwith resubmit above with copy I-94 (both front and back) and I797 approval(both front and back)

AFAIK, you need a valid visa in your passport stamped. Then only they approve the dependent visas. This means that you need to travel there and get your visa stamped too. By best friends case was similar and he went and come back with his wife. His was h1 and H4 case.

FYI. The 797 is not a visa. The consulate officers gets irritated if you says that "your visa is approved and you just came to get it stamped". It a personal experience.

We submitted the expired stamping with valid i 797 and I 94, coulpe of latest paystubs, all W2s, Employment verification,everything.

Doest that actually means I have to go back for stamping and get stuck in same process?

Vinrobo: do you know when was that inicident happened to your friend and how easily your friend got thru H1 stamping?

He got through the H1 without problem. But this was in 2006. Not recent.
Please follow current trends for your case.

Hi Folks,

Alternatively I have question how advisable it is to go to Canada for L1 stamping? This is 2nd approval and firstime approval was stamped from India and was valid until 2010.

Just wanted to check if anybody has experienced any problem of stamping in Canada?
