I am in US since Feb 2008 on L1 visa. My employer has recently applied for H1 in 2012 with 'change of status'. I have the following questions :

1. How long the H1 would be valid. is it for full 6 yrs or till Feb 2014.

2. Can I change my employer once my H1 gets activated. For 'change of status', I need not wait till the consular stamping is done and can consider it activated once the H1 Petition comes, right ?

3. Do you think there is sufficient time for my new employer to apply (getting Labour and I-140 approved) for Green card before H1

expires.

Thanks.

1. you might get 1 year of h1 or you might get 2 years based on the when the approval date. L1+H1 = Max 6 years ( Feb 2008 till Feb Feb2014 is the max you can get as of now).
2. yes, but you need to have 3 to 4 pay stubs on h1
3. i think so. but consult attorney or new employer to confirm.

Can I not switch employer in H1B (just after getting it activated) unless I get 3 to 4 pay stubs on H1B.
