View Full Version : Pending 485 and employer change might occur before 180 days

Hi,

My company (A) is planning to outsource our department to another big consulting firm (B). We will still be working for the same company A but I will probably become employee of the consulting firm (company B). Now I applied for my GC through company A in Sep'2008 in EB2 category and have got my I-140 approved in June'2009. In Jan'2012, I became current and I applied for I-485. I have received my EAD in March'2012. So now here are my questions :

1.) What happens to my I-485 if I now have to move to Company B ? Will it still be valid ?
I have read on some other forums that as long as I-485 doesn't get approved in 180 days, I can still change the employer and inform USCIS after 180days have occurred about using AC21 portability. Is this true ? There is lot of confusion on this matter, so any good information will be highly appreciated.

2.) Can my company A still revoke my I-140 ?

3.) If my company A revokes my I-140, does it impact me since it more than 2 years after the approval ? Will my I-485 still need a supporting I-140 after receipt of EAD ?

4.) I am still working on H1B. Do I need to start working on my EAD before the move/outsourcing occurs ? I was planning to join Company B on my H1 status only and then after 180 days from my I-485 application date, I was thinking of using my EAD. Please advise.

5.) What documents should I take from Company A before I leave it ? Eg termination letter and reasons for termination etc. I read in some forum that this will be helpful in filing AC21 portability.

I would greatly appreciate if you can respond to each question separately with your thoughts/inputs/suggestions/experiences.
