View Full Version : Very Urgent/Frustrating H1B Transfer Case[HELP PLEASE!!!]

Dear All,
I am new here so pardon me if I did not observe certain posting rules.

My case is very very urgent.

I filed my H1B transfer on Apr 4th and now it is May 9th and I still did not get an even receipt no.

I talked to company's lawyer and they said this was the first time they encounter this case.

I called USCIS and they very coldly tell me either wait or re-file. which is useless. "Either Yes or No" kind of suggestion.

So shall I keep waiting?

What is bad if I re-file and cancel previous check?

Is it normal to observe such more than 30 days wait during beginning Apr period?

Thanks so much. It is so frustrating dealing with those immigration authorities, or government in general. =( They are treating you like beggers.

Did you check your cheque is enchased ?

and did you chcked your mail is delivered or not. Do you have tracking number ?

Thanks for your reply.

The check is not cashed.

The Fedex tracking number showed that it was received Apr.5th. which is right because we sent as overnight delivery.

I can tell suggest you 2 options which worked for my friends:

Option I:
Wait it out. Dont refile unless your company HR/Lawyers support that decision. Some of my friends got the receipt notice and the approval in mail together last year.

Option II: ( i think this might be the best if you are impatient)
Based on what i see you have filed as normal. I would say request the company to make it to express by paying that extra $1000 or so (most companies do that without issues as immigration is first for them to retain employees). Once they change the filing status from normal to express you might (again this is just an option) see some movement in your case.

Again these are just options please consult an immigration attorney or your companies lawyers/HR.

Regarding your Option 2: If my case can't even be found in their system, can I still top up 1000 USD to upgrade the case to premium processing?

I called them and they can't locate this case in the system, as I did not have any receipt no. etc. looks like it is still sitting in their mail room untouched for more than a month....

Can I upgrade without receipt no.?

Did you double check the destination is right? ( Where it supposed to go?)

Can someone please let me know how long does it take to recieve the H1B Transfer filing receipt ?
