2011- My labor was filled last Feb. Since i was nearing my 6yr on H1B my attorney advised to file it in EB3. So labor n i140 got cleared and i got 3yr extension on H1B as well.
2012 - i was asking employer to file new EB2, but they declined. I talked to the direct vendor to the client, and they are ready to file new EB2. But now after i informed about this to the employer, they are also ready to file. these guys are comical.
My questions
1. I had spoken to a lawyer during the free lawyers call, and she had said that its possible for the vendor to file the PERM even if i am not their employee. Has anyone done it or heard this with a positive outcome?
2. Can both vendor and employer file the PERM. I know technically its possible, but are there any other issues that might arise?
