View Full Version : RFE on H1B extension process (7th year, I-140 already approved)

Hi, all.


I would appreciate your opinion on my chance for
H1B visa extension approval.


Anytime you receive RFE, you feel like you are doomed.
While this is not the first time I received RFE, I am feeling
very anxious.

Currently, I am in the process of H1B extension through
a reputable lawyer. USCIS California Service Center
replyed with RFE. I am informed that the California Service
Center is notorious for issuing RFE.

I have not seen the RFE letter, yet. So I do not konw
what they are looking for, thus, I feel very nervous.
I'm really hoping that RFE has simple request, unlike
last time...


Industry: Hospitality

Along with the I-129, I submitted...
* Pay stubs for the last 3 months
* the most recent W-2
* Certified LCA
* G-85
* Organization Chart
* Support letters from my customers and references & a certain government official.
* Sample material/document of my work
* 14-page letter
(description of my job, case # for the approved I-140, etc... a lot more)



I am feeling very anxious...
I really appreciate your assesment and opinion.

Basically, the RFE I received is requesting proof that my position require
4-year degree or higher. There are 5 pages in the RFE, including the cover page.

My lawyer is analyzing and researching what needs to be submitted.
She will let me know what evidence I need to gather ASAP.
Reading the lengthy RFE, I feel I am blessed that I can (barely) afford
a lawyer to handle it.

I'm in the hospitality industry; working in one man office.
Obviously, I have enormous amount of responsiblities; sales,
marketing, PR, reservation, translation between English and Japanese...to name few.
While this is not the first time I received RFE, I am nervous.

My lawyer received RFEs for 4 other clients; the RFEs are identically the same
except for names, job titles and case numbers. She said that the RFEs seems
to be printed out of "boiler plate."



I would appreciate your thought on this matter.
