Our Esteemed PM was in talk with Prez GB about a year ago to get back the SS and MC money paid for all H1B's who have paid into the system but would not get a dime from it..please could somebody with good writing skills would write a letter to PM so that all people can mail/Fax/Email our Respected PM urging him to take this issue up with the new administration. Also we need to request our PM to take up the issue of lenghty delays we face.

You cannot ask Indian government to help directly to get your GC and Citizenship of USA (thereby loosing Indian citizenship). SS/MC issue can be addressed though, since it is for people "returning" to India, as good Indian citizens.

Actually I too thought about taking help of Indian politicians in this regard. But I dont know the effective channel to get there. Jan 10 is NRI day and is celebrated in a big way in India and it is usually given good media coverage. PM usually participates in this event. Dual citizenship scheme was announced in this program a couple of years ago. May be we should do some ground work to get to the right people in this celebration committee with right inputs so they can help at least attempt to help us.
SS is really important to cover our dependants. We need to take this seriously. If anyone has good suggestions, please PM me.

Maybe we should plan to recover SSN in lump sum rather than routing through Indian PF system. A few years from now US may not have any SS funds.

Around 15 years back I saw an Indian couple at the passport office with a bunch of files in different colors. I got curious to know why he was carrying so many files in different colors. I noticed that each file had a label and it said \"USA File\", \"UK File\", \"Canada File\", \"Austrailia File\",.....and so on. At that time I laughed my balls seeing his desperation to get out of India.
Now I see every other guy on this forum is just like him. Stop judging your status by the country you live in. Do something worth while so people know you for what you have done and not for where you live.

First of all let me make clear i am Indian. I dont know where our loyalities are, on one hand we are trying for green card and eventually go for citizenship. and here some one is writing our time will come and all that stuff. This country has given us a lot. If u were seriously planning to move back to india u would have never applied for green card in first place buddy. I am ashamed about ur thinking.

Actually I don't understand why people are so fussed up about SS and MC dollars. Medicare is going bankrupt and Social Security will be able to pay only much reduced benefits 30 years from now. This is a totally useless investment. Why bother about it when everybody is anyway going to lose money in it? If you have plans to move back to India then do so without thinking about this loss. You can make it up by getting a good job in India today. Infact the earlier you move back the better it is because then you will lose less by paying less to uncle Sam.

Overseas Indian Affairs Minister Vayalar Ravi said in New York on Friday that New Delhi is trying to negotiate for an agreement with the Bush Administration under which temporary Indian workers in the US would not have to pay social security taxes.
Talking to a small group of Indian journalists Ravi said during the visit of Belgium prime minister Guy Verhofstadt to India earlier this month an agreement, called social security agreement, was signed with Belgian Foreign Minister under which Indians who would work there for less than five years would have the option of paying their social security taxes in India rather than in Belgium.
'We are also negotiating with the United States for a similar kind of agreement,' Ravi said in response to a question. He said such agreements would also be signed with other European Union countries as well following conclusion of negotiations.
For hundreds of thousands of Indian H1B workers in the US, the mandatory payment of social security tax has been an issue since workers who go back to India after six years of temporary employment in the US either voluntarily or due to lack of sponsorship for permanent residency cannot claim the money they had paid from their earnings. For the permanent residents and citizens, social security acts something like a social insurance program at old age.
Since the 1970s, the United States Social Security Administration has a law in place known as "Totalization Agreements" with about 20 countries. Under the rule H-1B workers are exempted from paying Social Security taxes in the US and can have their deductions sent to their home countries.
These countries include Austria, Belgium, Canada, Finland, France, Germany, Greece, Ireland, Italy, South Korea, Luxembourg, the Netherlands, Norway, Portugal, Spain, Sweden, Switzerland and the United Kingdom.
Neither India nor China, the two countries accounting for the more than half of the all H-1B workers in the US are not included in the list evidently because these countries have no social security systems.
Ravi, however, did not explain as to how India, which does not have a social security system, would negotiate with the US for a similar exemption for Indian workers.
The minister was in New York ahead of the 5th Pravasi Bharatiya Divas to urge NRIs for greater involvement in the country's development by way of making investments in various projects and fields that are open for investments.
'Indian Americans have one of the highest incomes among all the ethnic groups in this country and they can participate in their motherland's development more substantially if they want to. I am here to encourage them to do that,' he said.
Ravi, who addressed a number of community meetings in New York, is going to California to attend the annual meeting of the National Federation of Indian Association, an umbrella organization of Indian organizations in the US.

Calculate all the money we have given to SS and MC after being in US for all these years. If these payments are refunded, that will be a good financial backing for people who decide to move back.

I think most of you guys either don't know anything about Indian politicians or don't understand our uselessness for them...If you talk to Vylaar Ravi today he will take 30 minutes to recollect what he talked 2 years ago...These are one of 50 useless promises & talks they do everyday, but end of the day only those works are take up which can fetch them votes...The current govt. will work more on socialist agenda, as they got votes for NREGA & several other social program. Who cares about non-residents when the USCs are also not getting benefits? That's the whole point. Non-residents are at the bottom of the food chain and are voiceless. When the country itself is in crisis how can the country care for non-residents? No country in the world would and US is no exception.

Other countries may have signed agreements with India but that still does not guarantee payouts to Indians. For example during a financial crisis or war benefits will be first paid to citizens only. Also, the impact on those countries may be infinitely less than it is to US because of very small Indian communities in those countries.

We will make US care for non-residents at least in this issue.
GC is something US can decide whether to give or not. This is OUR money US gov is illegally withholding.

My dear friend, US is broke, they are pushing their hand deep in our pockets to take out maximum money they can in the name of Immigration Document Fee increament up to 3 times...Issuing 1 year documents valid from the date of issue(so they can eat 3-4 months), This is no less than "Jizya"....Here we are paying "Jizya" on the other hand you are hoping to get the tax back...You guys are day dreaming.. There is nothing illegal about it. Read the law and you will know why. Yes you have the right to feel bad about it but why feel bad about so little money which will be of no consequence to you anyway because you can only get it when you are age 62 plus. Refund of your taxes will never happen so you can forget about it. Your options are to either hang on infinitely in US until you become a permanent resident and hope to get some piddly amount upon retirement in US or go to another country now or home and build a successful career which will reward you many times more during your young and productive years. Consider the SS/MC taxes as charity for current beneficiaries. You may feel US does not have culture of charity but at least your culture does? Doesn't it;)?

Don't get me wrong, I believe you should definitely try but you have to be realistic about your chances just for discussion sake. The chances of this happening are very slim today due to weak economy, debts, and bankrupt MC and SS programs. Basically there is no money to pay.

Don't be childish. Every country in world derives law in a way that will benefit the citizens first. The intent is not to rob immigrants but to cherish the values of citizenship. Germany, Austria and Switzerland have significant Turkish muslim minorites who do not have easy right to citizenship even after being born and rasied there. UK & NZL do not automatically grant citizenship to children born to immigrant parents there. The discrimination towards minority immigrant communities in those countries and many more is profoundly more than what it is in US. US is not denying you right to GC. Where did you get that from?

Our Esteemed PM was in talk with Prez GB about a year ago to get back the SS and MC money paid for all H1B's who have paid into the system but would not get a dime from it..please could somebody with good writing skills would write a letter to PM so that all people can mail/Fax/Email our Respected PM urging him to take this issue up with the new administration. Also we need to request our PM to take up the issue of lenghty delays we face.
Let us get back to business.
Please bring up some points we should mention in the letter.
We will draft a letter once we have the points.

You work is a big corporation on a very critical project. Now one day you see their is a process which actually makes you (the developer) code the same thing 3 times.
This process has been in practice for many years, for some reason of the past. Now this doesn't make sense. There are some members of the management who do not want to change the process as they get a free copy of the code without any effort.
What would you do , just resign and what out, or raise your voice to change the process as it makes so much addition work for you.

India has been in negotiations with US for the past 10 years on this issue. But after the nuclear deal.. Bush admin showed some inclination to conclude that deal...but i think that was all a sham...
there was some concession.. i think ppl who work here for less than 3 years can move their SS to India..but not to their pvt acc..but to the PPF (the indian pension fund)... and if you have worked here for 10 years and move back to india.. you are eligible for pension ...in US or in India...
i think indias are responsible for the delayt.....As india has no comparable SS scheme..(like most western countries)....so if u are following the news..u will see the indian govt plans to revamp the pension scheme..and a bill has been introduced in the parliament... it will happen when it will happen.... so ur letter campaign will make you guys look stupid (to be mild)

We shud first get the letter drafted properly..and then probably put it in a bog or open a group in LinkedIn...once we get sizeable "digital" signatures then we can send it top leaders in India..

do you even know why the indian govt recently introduced a bill to reform and provide a SS blanket for all citizens... US cant release the funds as india has no comparable SS cover for its citizen ..so india has to put its house in order first... ( so thats the hold up....US has similar arrangements ith 20 countries ..because they have a SS plan thats in par)
And this issue already part of a larger indo-US deal....
This issue was first picked up during ABV tenure..then there was some initiative during MMS govt..until US cleverly linked this and other benefits with the Nuclear deal... so it will happen..sooner or later...

Rightly said. Why should India change its laws to accommodate some non-sense US laws ? Better change the US laws.
It is a known issue that US Social Security is a ponzi scheme. If the system was well designed, it would never face funds shortage when baby boomers retire.

As of now, if an Indian does not hold a permenant resident card, 40 points in SS is down the drain and the money paid to SS is treated as right to work. This is what the customer service guy at SSA told me few weeks ago. The point is, the existing laws alreadys disallows these benefits.

This is not correct.
Per existing SSA rules, one can claim SS benefits irrespective of citizenship or Green Card (you obviously need 40 credit to claim) . You are entitled to it no matter where you are (except for a few countries) .

Your own lawyer you pay for filing your application and your own desi employer does not answer your emails, and you think your Minister will answer your email? Huh.
Do you really know how difficult it is to even get a meeting with a minister in India for 1 minute? Do you know how difficult it is to get any work done?
If you care so much about your SS, why don't you make a trip to India and meet the minister in person for it?
I am surprised the high skilled community thinks that sending emails will get them grencard, social security money and what not.

When you tell the raw truth, people feel offended.
They talk about influencing Indian Government but want to do it via email as if the government will value their emails.
If you canot go to India, at least form a team and go to Indian embassey and meet the ambassador in person. Let us see how many will be willing to spend their own money, vacation and time to do it.
What I am saying is that it is very easy to sit and send emails and think that you have done your part by sending a junk email from a fake ID and now the problem will be solved. But try to do more than send email.

What I am saying is that it is very easy to sit and send emails and think that you have done your part by sending a junk email from a fake ID and now the problem will be solved. But try to do more than send email.
Going in person and meeting ministers will be the best thing to do. But contacting these ministries via Emails, faxes, snail mail etc will have its impact to a lesser degree.
Indian government started the "Totalization Agreements" effort without us requesting anything. So Indian government has a vested interest in pursuing this agenda. All we need to do is give a push via face-to-face meetings, snail mail, email etc.
