Lets have a poll on EB3-EB2 conversion(means: starting a EB2 GC process and porting the EB3 Priority date during I-140). This is just to give some idea on the trend in this conversion.

Intension is people who are thinking of this conversion, can get an idea before jumping into this.

If some one wants to give addtional data.. please post a reply

Thank you for the one who responded.

So far its looks like a 50-50 chance for success. and 75% chance of RFE. I think its not bad.

Others please respond.

So far : Chance of RFE : 71% - I'm assuming that denial also received RFEs
Success rate : 28% - based on concluded cases only. even if people filed MTR on denial case for the calculation I'm counting as fail case.

It will be good to know when the successfully ported Labor/I140 were applied for.
My (company's) lawyer said that in today's economy - ALL labor (PERM) applications will be audited. Audit means delay of another year easily i guess.

Success rate = 50%
RFE Rate = 54%

These are good for any one who is planning for the conversion...

seems like most of the EB3 people not yet taken this path..

it also depends on when the EB2 was applied.
Right now, almost all EB2 apps are getting audited.

I agree that "when" plays role in RFE/Denial.. but the RFE for EB2 trend started in 2007. I believe late 2007. Its been 2 yrs since.. Not sure how many people started this EB3-EB2 conversion process before 2007..

Results..so far : Success Rate - 54%
RFE Rate - 60%

Looks like there are very few attempts for conversion..

I think EB2 people need not worry about it.. :)

.... But through NIW.

We were pleasantly surprised to find that her EB2 NIW was approved early this year(applied in AUG. 2007), as we applied it ourselves, no attorney. Since, she qualifies for EB1 too, we self petitioned for EB1 also.

this is good. Most EB2 cases waited for 5 to 6 years for GC due to EB3 folks converting to EB2 and labour substitution . Its good that DOL is auditing EB2 cases and few # of EB3->EB2 porting cases. I hope EB2 who studied MS/MBA and invested 2 years in advance study get GC faster. fewer porting cases mean less EB2 wait time.

Wake up and face the reality my friend. People who think logically and practically know that converting from eb3 to eb2 is a mirage, in this environment it is difficult to just hold on to a job so how are you going to file for perm. Even if an employer is willing to file for perm, no employer is willing to file eb2 not even desi employers because by now everybody including the attorneys, HR know that DOL is cracking down on all perm especially eb2. so if you are lucky you might get eb3 but then DOL is taking upto 9 months to an year to approve even an eb3 perm, if it is eb2 forget about it. The poll results prove that 50% of the people got rejected in labor and 140 stage, only 25% were successful, these people were successful because they filed there perm during better times almost 15 months or before.

nobody is able to get an employer to file even eb3 perm application, people are returning after 6 years of h1 because they cannot find a single employer willing to file even eb3 perm and here you are pumping this thread as if eb3 to eb2 porting is like a walk in the park.

why dont you support visa recapture, if visa recapture happens everybody would be current eb3 and eb2, there will not be any difference between eb3 and eb2.
