I have a question regarding my scenario.
1st Green Card -->
PERM labor applied - June 2006
Received PERM approval - July 2006
I-140 Filed - September 2006
EAD and I-485 Filed - July 2007
EAD approved - September 2007
I-140 RFE - October 2007
I-140 RFE responded - December 2007
I-140 Denied - January 2008
I-485 Denied - January 2008
I-140 MTR filed - February 2008
EAD renewal denied - September 2008 (reason - I-140 and I-485 denied)
2nd Green Card same company as 1st GC -->
PERM labor applied - October 2008
Received PERM approval - December 2008
New I-140 applied - April 2009
I-140 RFE - June 2009
I-140 RFE responded - September 2009
I-140 RFE approved - September 2009
1. Now my question is that with this scenario; Can I renew my old EAD which was approved on September 2007 using the new I-140 approval from the same company? or I will have to apply for a new EAD and new I-485 once the quota re-opens?
You can get EAD only after filing 485. Since you dont have 485 (previous one denied) there is no way you can renew old EAD. you might have to wait and apply 485 when your PD becomes current and then EAD. You cannot even port your old PD since your 140 was denied.
