View Full Version : Spouse on EAD 485 derivative pending got laid off. Can she get unemployment insurance

My wife recently got laid off. She is EAD 485 (derivative) pending status. I am the primary on H1B visa not using my EAD from 485 pending status.
Questions
Can my wife claim unemployment insurance? Can it have any negative impact on my application?
If it is potential problem can get just use re-training option and not take any direct unemployment insurance money. Please suggest.

murthy website link also states that spouse on EAD safer to enjoy unemployment benefits.
The concern is really when the primary applicant tries to apply for UI.
UI eligibility is not same in all states. Check out UI eligibility and requirements to see if your spouse qualifies.
This is my 2 cents while you are waiting for a lawyer's response.
