Hi,
My PERM was rejected two weeks back due to the fact that the offered wage was 8000$ higher than the prevailing wage determined by the SWA. My offered wage was specified as a range in the 9089 form and the bottom end of the range was 8000$ higher than the prevailing wage.
My firm's lawyer has applied for a re-appeal. I have only 4 months left in my 6 year H1-B limit. Also planning to extend this H1 based on pending re-appeal PERM.
What are the chances of re-appeal success and the lawyer says that if CO denies he is going to forward the case to BALCA.I'm not sure if it is worth it
1. Do I need to go for a new PERM based on the situation above
2. What are the chances of a successful re-appeal with CO
Thanks
