I found out that the backlog center lost my response to the 45 day letter. The lawyer contacted them then they acknowledged their mistake and fixed it. But it looks like it will take even longer for me because of their mistake. My lawyer told me it will take another 2 yrs or so. Anybody having the same problem? Will it take another 2 yrs? My case is Non RIR, No Labor certificate from the state, filed 2001/07.

I am very sorry to hear that. Are they saying it takes about two years to reinstate a case that was closed incorrectly?
First try to get the case reopened as early as possible. Then collect documentation regarding the 45-day letter (when you received it, when you mailed the response (UPS/FED-EX tracking code etc ...)) and consider suing them. According to BEC guidelines, they were supposed to tackle cases on FIFO basis. If they do not do it citing vague reasons, it is better to sue them.
I wrote letters to Elaine Chao and sent e-mails to Senators and nothing seems to move the BECs. Mine is non-RIR from 2001 November.:mad:
