Hi all,

I have come to US in jan 2008 on H4 visa with I94 till feb 2009 and in july 2008 I got my H1B approval and I got my SSN in oct 2008 . Due to some reasons like I was not technically strong to get a job in this market I was getting prepared and finally I got a job in March2009. I was not working from Jul2008 to feb2009. So I dont have any paystubbs during my jul2008 to feb2009 and I dont have 2008 W2. But from mar2009 till date I am working without any gap and I have paystubbs for all the months. Now I am planning to go for H1B stamping in Inida.
1) So will there be any issue if the VO asks me abt my W2? Are there any ways I can convince him?
2) Will the VO officer considers my previous I-94 which was valid till feb2009. And the time I was unemployed was within this I-94 expire time.
3)If my H1 is rejected is there any way I can start working after coming to US on H4 visa?
4) If my H1 is rejected.Is there any option like I can come on H4 visa and change my status to H1?

To begin with, how in the world you got H1 when you had no job, oh let me guess, you approached one of those consulting companies who first altered your resume then approached their clients who had no assignment at the time.. Result of above situation your crafty consultant made you sit on the bench without pay (which is illegal).. Now with some luck and more makeup to your resume the consultant was able to put you somewhere, and finally started paying you.

Stop this BS of "getting prepared for the job". There is no such thing as getting prepared. You get prepared while attending school.

Let me get you up to speed with the law:
1. No job means no H1 / No pay means no H1
2. No H1 means you can not work
3. If you got H1 and did not join the company then automatically your H1 is void

Yes, you will need W2. THERE IS NO WAY AROUND.

Your previous I94 is not valid since you changed your status to H1 and got another I94. The time you were unemployed is the time you were overstaying (which is continuing today as well).
3)If my H1 is rejected is there any way I can start working after coming to US on H4 visa? BIG NO (only if you come via Mexico on foot through the jungle at night)

Yes, you can come back on H4 but it all depends upon the office granting you the visa.
