View Full Version : H1B stamping and gap between 2 employers

I found this website very helpful. So, thinking to share my problem. I am planning to go India for a vacation. I was filling DS 157 where it is asking about my 2 previous employers information. My actual information is like as below.

Company name: Date of Employment

Company A 01/01/2007 - 06/28/2008
Company B 08/10/2008 - 03/05/2009


If you see my employment ended with Company A on 6/28/2008 and new employment started with Company B on 8/10/2008. I got a pay stub from Company A on 6/30/2008. And from Company A I got notice period paystub on 7/15/2008 and one on 7/30/2008. And got first pay stub form company B by first week of Sept for the period 08/01/2008 - 08/30/2008. So, I have continuous paystub for last 3 years. Only problem is that there around a months gap when I was not in Project. If I put the exact data about Company and Employment, will there be any problem ?


After Company B I joined another company C is there is no gap between B and C and getting regular payment from Company B and Company C.

Any kind of help will be appreciated !:)

You should fill forms with correct information. Since the gap is not too long, you should be just fine. Make sure you carry all the supporting documents from your present employer and tax filings/W-2s/paystubs for the last 3 yrs to justify maintaining your H1 status by earning the prevailing wage mentioned in previous LCAs. I am assuming you got the H1s approved with attached I-94 when company B and Company C filed for change of employer petitions.

Thanks for your response. Yes my H1B with employer B and with current Employer C has valid I 94 attached in both.
