View Full Version : NOID or RFE on 485/Is attorney needed or one can respond directly?

If someone switched employers using the AC21 option and received a NOID or RFE from USCIS
asking for a letter from the new employer attesting that the new (current) employment offer is in the same or similar occupation as was petioned in original I-140 petition, is it necessary to hire an attorney for responding or one can do it on his/her own?
Based on what I read, the response to these type of letters are typically drafted by an attorney who looks at the Job Code/duties/other details from the approved Labor/I-140(from previous employer) , compares with the new job duties and helps in wording the letter appropriately.
Is it necessary to hire an attorney or one can respond directly . Also can anyone provide a sample EVL letter for the same(especially how to state that the old and new duties and position are the same?
Note: I am not looking to get it done for free, just want to know whats the right process.

You can do it yourself - but for the bold reasons, you need an attorney.

We are in a similar situation. Received NOID with AC21.
After responding to 6 RFEs combined for our family (medicals, W2s, etc etc. .......) we received NOID for AC21. It seems like the IO at USCIS is looking for reasons to deny the application. Our frustration is beyond words right now.
Any words of wisdom from someone in the same position (NOID on AC21) or someone who successfully crossed this hurdle will be very helpful at this moment.

Responding to NOID is fairly simple than doing a MTR. I would recommend to work with your attorney to clean up this mess. Follow chanduv23's postings for greater detail.

Yes, It is quite easy to handle this. I got a super good attorney and he took care of everything in a day and mailed response to USCIS on the 2nd day. On the 4th day I got the USCIS update saying that case processing has resumed.
