Can I apply for EB5 when EB3 is pending?:confused:
Okie guys don't jump on me for this question, this question came to my mind, when I was day dreaming( well no projects going on at the moment;)) so I was dreaming if I win a lottery of a million dollar:cool:, and was making the castle in the air (wish list:rolleyes:) and then came the point of getting GC using the EB5 category. So this is how this question popped up.:D
Does anyone has an answer for it , so I can get back to my dreams where I left. :)

You can but the source of investment i.e. money should come from outside of USA. I also ventured in that direction and that's the advice I got from attorney.

So I win the money or get the money thru some source (legal definately) and then walk out of the country and then invest it back in here , does that make one eligible for EB5?
You can but the source of investment i.e. money should come from outside of USA. I also ventured in that direction and that's the advice I got from attorney.
I hope your dreams come true! :)

:D .. I was imagining that i would become a religious worker and reapply. As it is i write code and then pray that it works...from now on i will pray and then write code that works...maybe that will make be eligible for religious worker category...working religiously to find the answer. :D
better yet ...i will appreciate it if someone can give me a birth certificate from tulavu (i hope that country is not retrogressed)... i can use cross chargeability on the evidence of new birth certificate information.

In order to deter fraud, immigrant investors (EB5), their spouses and dependent children are subject to "conditional" permanent residence for a two-year period. After two years, the entrepreneur is eligible to file to end the conditional status. To do that, the entrepreneur must have continuously maintained the investment during the conditional residence period. The entrepreneur's residence may be terminated if it is found the business was not established or was established solely to evade immigration laws. The INS will examine the business at the end of the two-year period to determine whether or not the individual has complied with all of the EB-5 visa's requirements.

Dont worry too much saxena. Chances of being hit by a lightning is much higher than winning the lottery. So try to avoid plain open fields, walking under tall trees and worry about how to avoid being struck by a lightning bolt before being concerned about what to do when you get the lottery.

What if I make 1 million dollar from stocks or real estate in US and invest it in US . Am I eligible for EB5?

If you made 1 million, why will you stay here?
Go back to India and live like a king. Greencard is not worth it. Even with one million you will live like an ordinary guy here. But with one million in India you have better chances of making your business successful with a huge investment and live a better life with servants around you.

All EB-3 India candidates would be eligible for Religious workers category after 15 years of wait. Their cases would be transferred to Religious worker category on its own. USCIS believes that after 15+ years of mental torture, they are better suited to work in temples and churches than in some software development center. Also, it is a point to be noted that 5 years after getting the green card, they will be able to become naturalized senior citizens. This process can only make them senior citizen of this country.
We applaud this great initiative taken by Janet Napolitano and USCIS.

I have done some research into this category.
500k option seems easy but it has also some string attached.
Few basics of EB5
(1) Fund needs to be legal. If you bring from India then there should be enough trace of funds. Lets say some one gift you money in India then you need to show that you paid gift taxes in India. If you get gift from some one here then you need to pay close to 75k as gift tax in USA.
(2) I searched for few regional center program and almost all program charges 30-50k administrative fees ( Application Fee ) which is non refundable if GC denied.
(3) If you borrow money against your property in USA or India and invest into this program still you may not be able to balance it. Average Loan rate will be 10- 12 % while average return in Eb5 regional program is 6 - 10 %.
(4) You cannot withdraw money for 3-4 years. Some program ask you to make commitment of 5 years. Also no one specify exit strategy.
(5) Some program hold your money into Escrow account meanwhile you get your GC and once they collect enough amount to kick start project they will not give you any damn return. ( Just interest rate which is very very low these days ) so lets say you invest money today and they cannot collect enough money for next 1 year then you need to wait for 1 year to have them invest and another 1-2 year for them to start giving out return. and besides that once return starts there will be a commitment for certain years.
bottom line is if you have spare of 600k-650k money and not expecting more than 0-5 % return on that money you can go for EB5 for shake of GC. if you have 1.1 - 1.2 million then
you can buy business and employ 10 full time USC. That can give you more return.

Dude, you are exactly right, and why even bother starting a business?
At todays exchange rate, USD 1 million is equal to INR 4.5 Crore. Even you just PARK it in a bank at a measly 2.5% return, you will earn roughly INR 10 lakhs in interest alone, every year....While 10 lakhs may not sound a lot but, hey that is about what an average Engineer makes in a year after breaking his back for 14 hours everyday, and taking crap from his boss.
If I had this choice, I'd go be a teacher in a private school and park my money in a bank.

USCIS might end up having two birth certificates for you...one from Tulavu and one from your actual birth country:) Interesting situation..ha ha

'like a king' - I have heard this many times , can you please explain how a million dollars can make you a king (you can take any king as example for comparison):D
