Sen. Grassley and Sen. Sanders have introduced WARN act. This bill requires employers to certify that they have not and will
not lay off a large number of employees before they are allowed to employ foreign workers.

Anti-immigrants are gearing up to oppose our provisions as time approaches for Immigration legislation. We need to be aware of these bills and the fact that these are designed to throw immigrants out of the country. While we are busy discussing about spillover rules and other small items that are in reality non-issues, antis are busy figuring out how they can uproot our lives and careers through such bills. It would not surprise us if such provisions are tried as amendments in other bills. Immigration Voice will oppose such provisions and will work on making sure they do not go further. We need to focus on the upcoming legislative activity on Immigration Bill. Discussions such as spillovers or wasted visas will no longer help. There are no wasted visas anymore. For the ones wasted in the past, it will take a recapture bill to make them available. The harsh truth is that there is no easy fix.

No chance on its own.....But they typically get attached to other bills.

Say if they table CIR these bills will be attached to the bill to act as poison pills
and eventually Tech industry will lobby against the CIR and it will come crashing down.

Mr Obama wants TARP money and he did sign TARP law allowing piece for H1b ban for TARP banks. Same way if they finds that Mr President and Hispanic Caucus are desperate about Illegal Immigration then they will throw anti legal provision left and write. And our beloved president will sign it under pressure of Hispanic Caucus. Democratic government is always BAD for legal immigration.

As I understand, Senator Grassley has been trying to ensure that H1-B is not being misused with the help of USCIS and Homeland Security. The question then is that once there is a system which ensures that employers are not abusing H1-B visa, why do we need WARN at all? The only logical conclusion seems to be an anti-legal immigration drive.

Considering the success of these senators in anti-H1B drive, I have no doubt that this bill will hit President's desk (in one form or other) for signature very soon.
Considering the implications of this bill, it will essentially shut down the H1B program while keeping it open. So USCIS can accept the H1B petition, collect the enormous fees and then deny it on ONE MORE EXCUSE made available to them.
Simply brilliant !!!!!!!!

My earlier interpretation that this bill covers only h1B was wrong. It covers I-140 also. See the link: -

Do you think this would affect those on EAD as well? Does it mean that those of us with approved EAD should switch back to H-1 B to be safe?

Take the job to the worker, if you can not bring the worker to the job...
Precisely the reason Microsoft and Google have operations in Canada.
These two lawmakers are engaging in nothing less than a witch hunt.
Also, I believe (correct me me if I am wrong), Grassley is up for re-election for 2010....he is trying to position himself in line with his constituents.

If CIR is introduced, following will be overall consequences:

1) Green card for all illegals(not legals) in US for 5 years
2)ALL cases under current EB resolved quickly to start giving GC to illegals standing back in line
3) People who dont have EB started yet are damned. They will face harsher Labor certifications and will have to wait even longer because 12 million illegals will be standing in line before they start their EB(or some other new) process..

In all, it about illegals not legals.

If CIR is introduced, following will be overall consequences:

1) Green card for all illegals(not legals) in US for 5 years
2)ALL cases under current EB resolved quickly to start giving GC to illegals standing back in line
3) People who dont have EB started yet are damned. They will face harsher Labor certifications and will have to wait even longer because 12 million illegals will be standing in line before they start their EB(or some other new) process..

In all, it about illegals not legals.

My profile is what it is. I am on H1B and my EB has not started yet because my employer has told me that he "wants to see my performance first for 1 year". Unfortunately, It is not a fraud, " "7 year experience" at entry level fake resume making" IT consultant. It is a Fortune 500 company.

Imigrait - et al,
Guys - hold your horses - this is not an Act - merely a Bill. There is NO guarantee that this will ever become a law.

If you've done your homweork, you will know that American parliamentery procedure is 99% based on its founding source , which is British parliamentery procedure - which is as I recall, almost exactly the same in New Delhi as it is in, come to think of it .... Ottowa, Canberra, Islamabad, Dublin, Harare, Pretoria and most of the rest of the former Imperial and Commonwealth countries.

A bill does not mean that it will be passed to become an Act - they draft the language such that when it is passed it is an 'Act of Congress' - substitute for parliamant of choice - I prefer "Oirechtas", but then - I'm Irish :) so the word Act is in the Bill

and even if it does pass - in most places you can challemge it's constitionality.

I wouldn't worry on this one - I do not think it will pass - there is already too much oppositon to it, and it's just those two posturing in the run up to the 2010 elections.

They will just end up forcing more H1 dependent employers to shut down shop and permanently offshore. Whose loss is it then. Have they even evaluated who the bill is going to impact and how? They are just punishing small to medium scale businesses for the mess created by poor regulation and large banks. Good luck keeping your businesses competitive with the rest of the world. :cool:
