Hi All,

I'm planning for a vacation in March 2010. My Visa is valid till June 2010. But my H1B work permit is valid till June 2011. I'm planning to come back in April 2010 after the vacation. Is there a need for me to go for visa stamping in india. Is there a minimum valid period on your visa to renter US. I really need this help to sort out my travel plans.

Advance thanks for your help.

Thanks,
Kalesh

you can enter the country as long as the visa is still valid. but if you no longer work for the sponsor shown on the visa, then you need to get a new visa stamp.

Avoid to go for stamping as they are issuing 221g in many cases which may take 1 to 3 months.

If possible avoid travel to India those who intend to get visa stamped on passport. I had been to the consulate and VFS office 7 times during my last visit. I went for stamping at Mumbai consulate.

I was given a 221g with adminstrative processing mark, and the consular offier told me it can take anything between 2 to 2 months for processing, she returned my passport.

My processing was done in 4 weeks time and I was lucky, I met many those who had been waiting for visa for month then month.

H1B = 221G in close to 60% cases, I was on a seperate line [consular officer who was looking at H1B/H4 cases and during my 1 hr stay I did not see even a single person getting H1B or H4 approval. The number must be close to 6 people ahead of me on the line.

If it is not urgent, please do not travel back to India in case you need visa stamping

Deepak

I am one of them, got cleared in 4 weeks, working for the same firm for last 5 years and have EAD and AP, thought of getting H1B stamped so that have not to renew my AP and EAD for next 3 years as I do not intend to leave my employer nor is my employer going to kick me out based on our organizations current finance state and work load pipeline.

H1B stamping adventure could have almost cost me my job had it taken 2-3 months....we do not have any off-shore office in India and working from India could not have been possible and staying away from job for 2-3 months might have costed me my job

Is your employer the same or have you changed employers recently?

Recently hearing some bad news about POE. Do a research and make sure you have all the docs in hand.

Read the other thread, which discusses about Newark POE. Sorry, I didn't meant to scare you, but always good to know the happenings.

I will be scheduling my interview for February 5, 2010 in Chennai. If your case is straight forward, you shouldn't worry. Tips suggested by my attorney
1. Schedule your interview on the day of arrival in India.
2. If your attorney filed your I-129 with 2 copies, your PIMS is already taken care of.
3. Take every possible document from your house tax forms to copies of passports of your dependents.

If there are no twists in your case, you will be approved without a question. DS-160 is to fast track the whole process.
