The Backlog processing centers announce with great pride and aplomb every month that 18 months are left /19 months are left to finish processing the roughly 350K cases. If the 13 million illegals are processed at the same speed as us , it would take them 56 years to get through all the cases. And the funny thing is..our employers have paid for the creation of these backlog centers.

All new applications are electronic. So this problem would not arise. We are the scapegoats for earlier paper based system.

What happens to people that come after the dust settles. I mean once the illegals are given a number (at the back of the line for argument sake) what happens to the legal dude that comes next day. Is he now behind the illegals?

let there be no doubt that the amnesty will clog up the immigration services. It has happened in the past, it will happen again. The illegal immigrants are not going to shell out thousands of dollars for processing each case, unlike our employers do for every H1B visa..where is the money for the extra manhours to process all these cases going to come from?

I heard this somwhere, when illegals got amensty in 1986 sometime, law allowed those were illegally entered country by before 1982 can apply for amensty.

however many enterd legally after 1982 could'nt take advantage and has to wait for many years, similarly those who enterd illegaly a day befor law passed claimed there were ther before 1982 and enjoyed amenesty

yaa talk about fairnesss

I like ur point though. Basically ahead of the line or behind the line. Somewhere down the line legals are going to suffer more backlogs. It wont the the same thing as 245i, but a similar situation.

actually it will be worse than 245(i). 245(i) was just around 500k I guess. This time around it's 12million. I shudder to think what it would be for the next amnesty program.

Once the bill passes, wont everybody who comes in after the implementation date be all "LEGALS" ;-) The difference would be just the visa category they come in.

yeah, even if they tell the illegal immigrants to join at the end of the line, lets say even if they are required to file a small form presently..informing BCIS of their whereabouts etc ..to start the process to put them at the "back" of the line..it still will have cascading effect by significantly slowing down H1B processing etc. That way, everyone will have to file H1B by premium processing

If 245(i) is 500k, will eb3 India be stuck in April 2000 till 2020..

Of course, it will be terrible wait..

of the 500k we don't know how many will come under EB3. Most will go towards EB3-OTHER which is already unavailable for the rest of the year. Guestimate is only about 10% (where ppl filed against jobs that require 2 yr experience)

there's a bandaid for all problems..
premium processing at every stage for another $1000.00 each :) by the time the H1B's get their greencard, they or their companies would have paid about $10K in legal fees/BCIS fees per person.Ofcourse their only motivation in shelling out this money will be the fact that they can recoup this money in the form of compensation (or lack thereof)
Now we have premium processing for I-130 too. Premium processing will be the panacea for all ills. That way, they can throw up their arms and say- guys.. sorry if your priority dates are current, it is going to take us 5 years to process your 485...oh by the way,you can always do premium processing for another thousand dollars
