Default H4->cos->h1

Hi All,

Here's my situation and really need some quick guidance

I traveled to US on H4 in Aug2008 while my h1 was under processing, got my H1 approval in 2008 Oct while in US but never used it, meaning never did a Change of Status.

I have an approved H1 but still remained on H4

Now, I secured a FT job and they want me to join ASAP.

Please advise the best way for me to get onto my already approved H1 ASAP. Apart from going for stamping and c2c

Thanks,
Padmini

I assume that the 2008 H-1B approval was not for a change of status (COS), but was approved as a consular notify. In that case, you can "activate" the H-1B status for that company by going to a consulate and getting a visa, or by filing a COS in the US from H-4 to H-1B. However, you should not do this unless you plan on working for the first H-1B employer. Your post mentions having a job offer, but it's not clear if it is with the first H-1B employer.
