Default prevailing wage for EB2

hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy. After discussing with people who have already filed in EB2 i get the feeling that this is too much amount and the wage requirement is somewhere between 80-85,0000. My lawyer is trying to downgrade me to EB3. I want to contest his claim but I am not sure what mistake he has made. What questions should I ask him to figure it out. Any help would be great.

You might have got classified as an Electrical Engineer by TWC, and likely Level 4 with 5 years experience as a requirement. If 5 years is really the requirement, and if you are an electrical engineer, or have an EE degree, TWC usually gives this designation. It is difficult to overcome this. Your friends who had lower prevailing wages must have been in different locations or had different occupations, or both. If your lawyer has lots of experience doing PERM, you can probably trust him.

If you get lots of stock options or other benefits like RSU's, faster prmotions etc. your basic pay might be lower. So you can ask the attorney to consider the total value of the pay package. You can get this from your HR person
