adjustment of status NOW while I am on a deferred sentence

My question - Is it safe to submit my documents for adjustment of status (Jan 2011) while I am completing my deferred sentence?

Scenario:
I am on a deferred sentence where I plead guilty for trespassing in agriculture and the Domestic Violence charge got dropped. I will be completing my DV classes by end of April 2011 or sooner. I don't know if this charge will cause an issue during the process for adjusting the status.

I am been told, by the time my interview date will be scheduled I will done with my DV classes n the deferred sentence hence I will not have an issue in the USCIS.
Reason - My husband is an US citizen and the interview date will take 6-7 months .

The reason i am alarmed is my H1-B transfer that was received on 12th Sep 2010 is still on the initial stage currently. So I am re-thinking and at the same we have decided to go to India by dec 2011 for a short visit.

Please advise what are the consequences and what I need to do to prepare myself.
