Technically if you lose employment in H-1 you are out of status, although there is an informal grace period that everyone here interprets differently.
How long have you been unemployed?

...looks like you are in a tough situation...try to get a H1B transfer ASAP, i know its gonna be tough in this market, but don't loose hope and keep trying...Good luck.
