Default I-131 Advance Parole renewal - earlier attorney wont give me a copy

Hi guys,

Its kind of sad but this is how my attorney is exploiting me. I was on H1B and my earlier employer filed my GC for me. I got my Labor approved, I-140 approved and received my EAD. Also an application for my Advance Parole was submiited and my attorney received the AP document.

Now I have moved employment to a different company and work on my EAD. I need to leave the country urgently but do not have the AP document...

* What do I need to do now?
* Can I call USCIS and ask them to resend a copy of the document? Will it be valid? The earlier AP was received in 01-2008.
* Should I file for I-131 or is there another form for renewal of the travel document?

Please help me out!

why dont you have the AP? The AP belongs to you and lawfully the attorney HAS to send it to you regardless of who the current employer now is. You need to approach the attroney and insist that he gives it to you.

Alternatives you can try. ( All my guesses )

1. Discuss with an attorney how to go about this. There maybe a way where another lawyer can get this from your old lawyer.
2. Call USCIS and explain the situation ( Better to take infopass appointment if needed). Maybe they can issue a duplicate AP for additional fee. Typically USCIS is slow to process. Ask them how to expedite your request.
3. Meet your congressman and explain the situation.

The AP is only valid for a year. If the AP was approved/received on 01-2008, it should have been expired by now.
