Default I485 filing

Hello,
I had exited US early this year due to visa issues. I have my I140 approved and have not yet filed my I485. Now that my dates are current, is there any way I would be able to file my I485 from abroad and once I have my AP / EAD then travel back to the US?
Pardon my ignorance if this is not logical.

I dont think so ..You can file I 485 only if you are residing in USA...

First check if your I 140 was filed as CP or change of status ( it should be on your approval notice of I 140 ) .

If its filed as CP then you are current you can contact the consulat where your I 140 was filed and they will probably schedule an interview for GC.

If your I 140 says that you are filing as change of status then you need to get back to USA to file your I 485.


Please contact a good attorney ..

you are current and have every thing set dont messit up ...

Thanks, mine is COS not CP. Do not have a visa to get back... ahhh
