Default 8th year on H1B (I140 aprvd) - New job offer

Hello,

I am on H1B extension based on an approved I140 in EB3 category (priority date June 2009).
Employer is a fortune 100 company.

I have received a verbal offer from a new employer, again a fortune 100, for a senior level position with minimum requirements that qualify for EB2 position.

Should I accept this new employment ? What happens to my current GC application ?

you will get 3 year extension on H1 with new employer. Key is to verify that they will file your GC ASAP in EB2. Good Luck

you can port the PD to the new labor in EB2 during I140 application.

Make sure that they file it properly in EB2 and gets cleared, otherwise you would be in soup. I am contemplating this for a while now.. what if new labor gets stuck in audit, what if they deny the i140. its a risk but if you are ready for it then go ahead.
