you can port the PD to the new labor in EB2 during I140 application.
Make sure that they file it properly in EB2 and gets cleared, otherwise you would be in soup. I am contemplating this for a while now.. what if new labor gets stuck in audit, what if they deny the i140. its a risk but if you are ready for it then go ahead. good luck.
