Since you are moving before six months of your filing of 485, your parallegal said the right thing. Its possible but its risky. The way it works is if there is no RFE on your case in the 180 days following your filing, you can then invoke AC21 to support your move. It doesnt matter at that point of time that you moved earlier. Now, if a RFE is raised and your company is ready to handle it - you should be good to go. Past experiences on the forum have been that in the first 180 days, it is very rare to get a RFE and considering we would be having lots of filing in the next month, the chances are even slimmer.

2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?
My personal opinion is that using a PO box address may not be allowed. But its my opinion. A lawyer would be the best person to advise you on this.


3. What are RISKS of moving from state to state during I-485 process? Did anyone do that in this forum?

Since its a PD portability case, probably no PD is written on the receipt. It might be to be determined.

I'm not sure if you can file your 485 as well - dont see a reason why not. But one thing you can do to have better sleep at night :-), is to upgrade your 140 to Premium processing. If you get it done tomorrow, you will have an answer and portability of PD by end of this month. Then you know for sure where you stand.

I would recommend converting regular I-140 into premium processing and get the approval at the earliest. Then file 485 ASAP. No one knows if the date will forward or backward in coming visa bulletins.

Hi,

I first applied Green card through the EB3 process and my priority date is March 2003.

Since there is very little progress in EB3 category, i convinced my company to re apply in the EB2 category as i got promoted (Salary increased) so that i can keep my old priority date. They re applied in the EB2 category and i crossed the recruitment stage and waiting for the PERM to get approved. (applied 3 weeks back).

Now i am current in EB3. Now, i am not sure whether i can go forward and file for I-485 under EB3 or wait for my new PERM spproval and apply for i-485 under the new EB2 category.

Please advice.

• Form 1-485, Application for Permanent Residence, with two (2) photographs attached and picture I.D.;
• Form 1-13 1, “Application for Travel Document,” with two (2) photographs and picture I.D.;
• Form 1-765, “Application for Employment Authorization,” with two (2) photographs and picture ID.;
• Copies of Form 1-94 and H-lB visa stamp;
• Copy of Form 1-797 Approval Notice for H-lB Petition;
• Copy of Form 1-797 Approval Notice for 1-140 Petition;
• Copy of passport;
• Copy of long form birth certificate;
• Copy of marriage certificate;
• Form 1-693, Medical Examination Results (sealed); (In medical examination go for chest X-ray instead of skin test).
• Form G-325, Biographic Information.


Try to read all the forms before you signed and send to attorney. Due to heavy work more chances to mess up the information from attorney side. Try to download all these forms from USCIS (some of these are fill able with save option) and try to fill as much as you can, at least your personal details, residency history in US etc and compare with your attorney documents when they sent for your signature.

Can I file for I-485 while I am waiting for I-140 approval. My PD is current under eb2 and my I-140 was filed on Jan-2007. I am going to upgrade to PP for I-140 but since lots of people will start going to file for PP, it is very much likely that NSC will issue RFE to reduce there workload. So my question is while I wait for I-140 approval, can I file I-485?

My attorney says he cannot promise June 1 filing b'cos of volume...but not to worry b'cos date is current the entire month of June. Is that true? Does FIFO matter?

After a long wait i have my priority date became current. But my employer is saying to wait for some more time before he can file for I485.What can i do in this scenario? He is saying the dates are going to remian the same for next couple of months.Please suggest.

If you have I-140 approved copy with you, you can file by yourself.
