Few Things:
1) Do not panic
2) Understand that the attorney owes loyalty to your company not you
3) Consult an independent attorney and find out your options
4) Have a cool and collected discussion with your employer laying out very clearly your concerns and why you think it is necessary to move fast on this. Many times employers think they can walk over you and you will do good to have a nice long discussion to tell him/her politely that the I485 stage can take upto 3-4 years or more. This is a fact because you may get stuck in name check or background check, you will have to do the medical get your AP and EAD and then you should have a visa number available after you are done with all the above. So tell your employer that just in order to start these processes, it is required for you to file I485 as soon as possible. Hopefully once your employer knows that you are not going to get your GC anytime soon due to the delays involved AFTER filing I485, he/she will budge and help you out. Also try to define a time line for filing the I485. In short have a rational discussion with your employer and don't be afraid to ask questions.
5) Have faith in god and be assertive, do not keep quiet or go to the extreme of trying to bring your employer to his senses by using legal action unless you have tried all of the above and he/she refuses to cooperate.

I am not an attorney, use my advice at your own risk.

Best of luck.

Default Fees incorrect on GCWaiter03 message

The fees quoted in this posting are incorrect, please double check the amount on each form as you download. I have just filed and I 485 is $325 + fingerprinting fee, I 765 is $180. Be sure to get your checks right when you have waited so long you do not want to give the USCIS reason to send your application back for the sake of a few dollars missing from the fee.

Seems like a good idea but doesn't this make them even mad and jeopardize the chances of the employee even more ???

Default Fees may be out dated. Check new fees in USCIS website

Hi to all,

These fees are as per Dec '04. These details are to give an idea only. Some of the information may be out dated like fees. But the lists of documents are right. You need all these documents fro each petitioner.

I am in the same situation. My attorney advised me to have one with my name if possible. I scanned mine and my wife's Birth certificate and sent it to my Dad in India. He said that he will get the original in 2 days. Looks like it is a straight forward process. You could just send it with a copy of ur passport.

P.S: They would need the copies to be notarized before taking it to corporation or municipality

Do we just need copies of the birth or marriage certificates or do we need to send in notarized or original documents.

I have copy of my birth certificate which I have been reusing. Not sure where the original is.
For spouse birth and marriage certificate I have originals

having a birth certificate is mandatory...this document will prove that you belong to a particular country and fall into that country limit etc...

regarding not having the name on the birth certificate one of the attorney said that USCIS is aware that some countries issue birth certificates without names and so it is okay with the parents name and 2 persons who(around our parents age) can notarize saying that we r our parents child is good enough..

Here is what my attorney recommended-

1. Get a "Non-Available Certificate" from the municipality
2. Get 2 people to provide affidavit (close relatives) in support of your birth date.

Hope this is helpful. Check with your attorney too.

Default EAD+AP Vs. H1B (Pros and Cons)

Which is better-

A. Working and traveling on h1b (stamping at the consulate needed every year)

OR

B. Working on EAD and traveling on AP (EAD and AP to be renewed every year)

Any insights would be graetly appreciated.

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
